    I would definitely use the 'cc' option rather than the 'bcc' one. Make DCB Legal very aware that your MP is involved (albeit uselessly to date, but DCB Legal won't know that!).

  • I emailed back to dcblegal before the deadline asking for an extension while I seek legal advice and also sent SAR to UKPC, today I received a reply from them and for the first time they actually mentioned that I have 3 outstanding tickets !! I don’t know whether it’s because I copied my MP in the email that had an impact or not. Here’s a copy of their reply:

    Thank you for your subject access request dated  31/08/2022.

    Please be advised that you have 3 parking charges outstanding on our system for your VRM YP62SWW.

    The information you have requested is set out below and in the attached documents. 
    1.    Photographs of vehicle for all 3 parking charges
    2.    Notice to Keeper for all 3 parking charges
    3.    Final Reminder for all 3 parking charges
    4.    Please note PDT data is not stored
    3.    Copy of Subject Access Request (attached below)

    Data Sharing

    You might want to remove your vehicle's registration mark from your most recent post.

    Your request for a thirty day delay while you seek legal advice appears to have been ignored. That's probably because they have no obligation to do that.
    They would however have to delay things while you seek debt advice had you asked for that.

    You have to use the right phraseology to get a 30 day hold (if you want one).

  • That particular car was sold on about 4 years ago not that it makes any difference to the case and to be honest I don’t even know what good it would do if I got the 30 days extension!! I am at a stage that I just have to ride the waves it’s been stressful and I can’t wait for it all to be over one way or another.

    Then it's no secret - give it to them again. No point in arguing.
  • Well I’ve just received an email from UKPC accepting the 30 day extension which runs out next week here’s a copy of the email below so I suppose it’s just a waiting game now for this particular one while I received confirmation of the nominated county court in Stockport for the first one but still waiting for the actual date.

    We write in response to your previous email dated 01/09/2022.

     

    We note you have asked for your case to be put on hold for 30 days whilst you seek debt advice. This was actioned straight away and will sieze as of 01/10/2022. On which date you will need to either pay or advise of your proposals. 

     

    In accordance with the appeal decision made on 29th July 2020 in Britannia Parking Group Ltd v Semark-Julien [2020] EW Mis 12 (CC), it is not correct to propose this claim should be struck out as an ‘abuse of process’ due to the contractual costs claimed. You may wish to seek independent legal advice if you are unable to access relevant and up to date appeal information and legislation.
