Hi guys before replying to dcb legal I went to Mcdonald and asked to speak to the manager he said because the charges are from 4 years ago he can't do anything about it since they have a window of 28 days!!! Then went to my MP explained the full story and this was her reply that it's very difficult for her to get involved once it's been passed over to become a legal matter therefore she is unable to help.0

That is absolute rubbish from your MP.
The only reason it has become a legal natter is because of the actions of an unregulated industry, and the previous actions and current inactions of successive governments. An unfair action four years ago is still an unfair action, even if a court claim has since been instigated.

This is the reply from my MP:
Thank you for your email.
Have you not contacted the company at all regarding the other two fines? I am just trying to make sure we are aware of the situation.
I have copied a link to the Martin Lewis Website which offers advice on what to do if you do not agree with the fine
https://www.moneysavingexpert.com/reclaim/private-parking-tickets/#section-fight
I understand the rules had changed around the parking in this area that you have always used, however if you did break the contract, albeit unwittingly, then the the land owner/manager can pursue this matter, as they have effectively issued you with an invoice which you have not paid. I understand the companies often did not take it to court as it is costly for them but they do have the ability to do so.
If you haven’t contacted the company at all then it will be best if you do so, and keep Mary copied in, we can then pursue this on your behalf. However if you have disputed the fine already then if you could send over any correspondence that you have we can get in touch with them.
Thank you once again for your email.
With best wishes,
Ruth.

Your MP is clueless. Fancy sending you a link to the dreadful, out of date, inaccurate "official" MSE site that will cost people money if they use the advice given there.
She needs to be aware that the private parking industry is unregulated; they issued three claims when the legal system says they should combine them all; have added on fake debt collection amounts that have not been incurred that Neil O'Brien MP formerly of the department for levelling up said is an attempt at extortion, use signage that is inadequate and has breached the BPA's code of practice for years.
I would expect my MP to support their constituents against these rogue companies, and if nothing else, make sure the fake add on charges are not permitted when the mandatory code of practice eventually comes into force, and make sure they do not send people to dreadful, unhelpful websites.

But she has said copy Mary in to your response to DCBLegal. So do that.
There are several examples on the forum of robust responses to roboclaim firms. Easy enough to write, or search for. Or are you at claim stage already? Your thread title says 'claim' so I presume you are working on a defence right now?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

When you compose an e-mail, you input the recipient's name in the box marked "To" and you also have boxes marked "cc" and "bcc"; put the e-mail address of "Mary" in either the "cc" when the original recipients will also see that you have done it or "bcc" where the original recipients will not see that you have done it.2

Make DCB Legal very aware that your MP is involved (albeit uselessly to date, but DCB Legal won't know that!).Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
