    If a court claim has been issued, you can't get this put on hold.

    Ah Okay. So this isn't relevant to me as I already have a Claim Form from the County Court Business Centre? I was just following the 2nd post in the Newbies section. Cheers
  • I've just had my response back from the DOP at UKPC. Their only response to the fact I have two separate claims against me that should be combined was the following:

    "Please note there are 2 parking charge notices against you which are both in Legal Action."

    Do I need to do anything else in respect to this or just continue to mention it in my defence and any other correspondence?

    The photos evidence is as follows:

    The first shows me being parked in the visitor bay of the private gated residence that requires a key fob. It shows the PCN on my windscreeen, but more importantly also shows that I have a permit displayed in the bottom corner of my windscreen. They have not taken any kind of close up shot to show that my permit isn't valid (it was.)

    The second shot is of my new car parked in the same bay. Unfortunately I had forgotten to transfer the visitor permit into the new vehicle.

    Both evidence packs show frankly terrible pixelated shots of UKPC parking signs approx 8ft in the air on a lampost nowhere near to the parking bay in question. 

    I'm more than happy to share images but wasn't sure if this could be detrimental to my case?

    With two different claims do I have to fight them on the same basis? Or should I fight the first on the evidence that there is a valid permit displayed and the second on the evidence that I had the permission of the owner to use the visitor space whilst visiting him? Or would it be easier to supply evidence of their terribly placed signs?

    Any help would be appreciated. Happy to share pics via DM if that is a more sensible way to ask for advice. Cheers

    Dear PPC,
    Well DURR! That's what I told YOU - and that you should be combining them as a single claim, something I'll raise with the judge when I win the first claim, so I get the second claim struck out due to Cause of action estoppel. :)

    Haha. Presumably this won't go down well If this is how I respond to them?! For now do I just make sure to highlight this in my defence statement (which section?) and continue to mention it in any other correspondences? Thanks

    Thanks. I'd already worked my way through 3/4 of the links but can't access the Telegraph one. I've complained to my MP too.

    What I'm unsure of is can I use multiple reasons for my defence? i.e I had a valid permit in one case, the resident had given me express permission to park there (and given me a fob) and the signage was beyond terrible and not fit for purpose. Or should I just focus on one thing?

    I think because I have two claims that haven't being combined it's confusing me even more as I could argue separate points for them.

    Is anyone also able to confirm if the pictures I received via my SAR request will be the only ones that can be used in court or will they be able to produce more pictures of signs etc that were in the car park on that date?

    A Subject Access Request is a request for a copy of your personal data that the company holds.

    Car park signs are not your personal data and therefore they are not obliged to send you pictures of any of them as a result of your SAR.

    Why do you want it 'to go down well'?  They are trying to sue you F*S (I don't think we're allowed to use the full initials any more, but I guess you know what I'm saying). Or are you looking for mutual understanding and reciprocity. 😮
