Is this the Backcester Lane car park? If so there are several people already fighting claims on this forum. There is also a petition to remove Excel from this car park. Three Spires own the car park.

There have been numerous issues with this car park and people have had similar experiences to your own. This information will be useful for your witness statement. People all having the same issues.
I was ticketed at Burton on Trent near the Travelodge. Excel are a litigious company but have been beaten at court.
You can also complain to Michael Fabricant if he is your MP.
Three Spires have now lost Mark's Simply Food and Debenhams. They really need to attract people into Lichfield and not put them off by engaging aggressive parking companies. Shoppers can now go to the West Midlands Designer Village where the parking is free.

Since I've had a final demand letter from them I'm a little unsure with how to approach the situation now, would you still complain to three spires or just ignore the letter and see if they proceed with court?1 -
I think that it will be either Backcester Lane or Gresley Row. They are near to each other and both are now Excel Car Parks.
I would complain to Three Spires. Unlikely to get your ticket cancelled but the more that complain the more likely that Three Spires are to remove Excel.
How you will approach this it to ignore the debt collection letters and just file them. When you received a Letter Before Claim (LBC) you will then need to respond to this denying the debt that they will say that you own them.
They are likely to proceed to court or at least to take it to the wire.

How did Excel describe the transgression? For example "failure to display a valid ticket"
Were you required to input your registration number? If so this should show up on their records. You can demand to see those.
As I have mentioned there have been many people that have had similar problems. If this does go to court copies of the comments made on the petition especially ones that are of a similar nature to your own could influence the judge. So the issues could be mentioned in your defence and the comments will back this up in your WS.
The fact that many other people are having similar issues and a petition has been started carry some weight. Everyone cannot be wrong.
One of the other people on the forum that are fighting the same corner may give you a WS to say that they had the same problem.
I think that Stefano has had a similar problem.

I think that Marley22's case may also be similar to yours. The driver paid but did not need to display a ticket.
I can't quite get my head around why a driver does not need to get a ticket yet they are issued PCN's when the driver has paid. There are a number of people who have had this issue but I can't understand what generates the PCN. When required to input a registration number then this should show on their records and match with the ANPR records and the amount paid. Are they sending out these PCN's when there is just a digit wrong?
I think that I will take a look at these machines when I am next in Lichfield. I won't park there though.
When you respond to the LBC demand to see the audit trail for the ticket machine and keep asking.

Stefano123, hatty60 and AVFC are all fighting claims as a result of parking in this car park. Stefano could not make a payment via app so left the site. hatty60's case is the same scenario as you. AFVC is a blue badge case.
