Jenni_D said:It is recommended in a court claim to raise mention of this, especially on the subject of getting the false debt collection charge removed. In regard to the £XX 'contractual costs' you will need to include in your WS this statement helpfully provided by legally qualified, regular forum contributor @bargepole.The Department for Levelling Up, Housing and Communities ('DLUHC') has published, as of 7 February 2022, a statutory Code of Practice which all private parking Operators are required to comply with. This states, at Section 9, that 'The parking operator must not levy additional costs over and above the level of a parking charge or parking tariff as originally issued.' In the present case, the Claimant has added a sum of [INSERT FIGURE HERE], described as '[INSERT DESCRIPTION HERE]', which is clearly contrary to the intention of the Code. Whilst it is accepted that the new statutory Code does not take full effect immediately, it clearly sets out the Government's intentions regarding private parking, and the Court is invited to strike out this element of the claim, irrespective of the determination of any other element.,We appreciate that some visits such as birthday parties or large group visits might take longer and the parking restrictions aren't intended to stop this. If you think your stay will exceed the stated maximum parking time then please speak to a manager in advanceAsk them to point you to the notice in the restaurant (or in any written communication prior to the party) that makes this clear, because you never saw it, nor was it drawn to your attention. Keep the pressure on them! Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

If they take you to court consider a counter-claim for for £500 for misuse of your dataYou never know how far you can go until you go too far.0

Not sure if this mcds is a franchise or not - it was in Fallowfield Manchester.
UKPC have added £60 to the PCN but then on top an extra £45 or so for 8% interest per year?!Already did the AOS and didn’t put in a counterclaim value so not sure if it’s too late now0 -
I would be challenging the interest - it was their decision to wait 3+ years to bring a claim. Also there's no way at all a £100 PCN could accrue £45 in interest charges in that time.
And of course there's lots of guidance about getting the false £60 knocked off.Jenni x1 -
slightly related - but issue has not yet cropped up
I have a resident permit and a visitors permit for my car park
The only reference to “visitor” in any terms or conditions is they “can park for a maximum of 3 hours in any one working day ”
Does that technically mean I can have 8 different visitors a day on the same permit?0 -

Hello, I filed my defence 25/02/22 and later received a letter from court confirming this.
How long should it take for them to send out the N180 questionnaire?

How long should it take for them to send out the N180 questionnaire? The CCBC sent you a letter saying the Claimant had twenty eight days to consider your Defence. What you don't know is when the CCBC sent a copy of your Defence to the Claimant. It follows from that that it is not known when the Claimant has to respond to the CCBC.Further, we don't know what delays there are in the CCBC that means they don't send you a Directions Questionnaire as promptly as you might like. Can I suggest that you keep checking your MCOL Claim History and as soon as you see that the CCBC has sent a DQ to you, you are ready to download a DQ, complete it and fire it back to the CCBC, remembering to send a copy to the Claimant of course?2 -
Hello everyone,
I received a date for court a while back and interestingly last week I got a letter from UK Parking Control’s solicitors offering to settle the case at half of what they would be asking for in court.
I didn’t respond to that thinking as I have come so far I should see it through to the end. Today I got a letter from the court and one from the solicitors saying a N279 Notice of Discontinuance had been filed.
I’m assuming that means the case is closed but could they change their minds and reopen this again at a later date?
Thanks in advance3 -

Another one bites the dust!
Don't disappear just yet. We need you. Motorists in this Country need you.
What a waste of your time this was, and why should there be such a litigation culture in parking? It's truly horrible being pursued for £100 for no reason, by an ex-clamper aggressive firm, isn't it?Join us in trying to end the conniving PPC and DRA 'added fees' fuelling the court culture.
There will be one window of opportunity later this year. My best guess is in October.
Together, we can stop the rotten parking industry from riding roughshod over the new statutory Code and the charge level caps, and otherwise bullying all motorists forever, using the regulation to gain kudos and status.
If you are not likely to pop back here every week to check, please set up email alerts for this forum and bookmark this thread (below) as we intend that one of us posts on it when the Government opens the Consultation:https://forums.moneysavingexpert.com/discussion/6333989/mse-parking-ticket-appeals-guide-feedback#latest
Read the latest posts there.
The PPC money-grabbers have blocked the new Code by filing for Judicial Reviews. Stopped the declared and much welcomed parking code from February 2022, which stated that added £70 false 'DRA fee' extortion was to be banned and that parking levels would start at £50.
It is all on hold. We need it reinstated.
This year will be your chance to make a difference, plus any other drivers you know (family, friends) who are also fed up to the back teeth with the greedy and unscrupulous parking industry and the stranglehold they have on people.
We need high numbers of real victims to make a point of responding to this final Consultation.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
