Hi All,

so the time has come and i have received the Notice of Allocation to the Small Claims Track (Hearing) this was received today in the post.

The claimant have until the 14th July to paid the final £85 fee and the date is set for August in court - pending they pay this fee.

It says i need to send Witness Statement 14 days before the court date which is after the 14th July.

Should I wait or start to write this?

Any help is much appreciated.

Nope, forget that example. Glad you asked!

It's out of date now.  Copy & adapt the WS bundle example from @aphex007 and start work on it now.

What do you mean by 'after' 14th July?

After 14th July but before the court date.  Don't assume the claimant won't pay the court fee, just crack on with your WS and evidence, get it submitted before YOUR deadline.  If the claimant fails to pay the court will stay the case, the claimant will bleat that the fee was paid and the stay will be lifted because courts/judges seem to give more leeway to claimants than defendants.
