More often than not the Claimant's WS is served either right on deadline, or even later. Just make sure you're not missing your deadline by waiting.  Do you have it ready to go?

I wouldn't send anything to a court outside of business hours, so I'd work on 4pm as the absolute latest time to email it (and, of course to the Claimant solicitor).
Yes, it's 99% ready other than just needing to remove a couple of sentences that could have been relevant had I seen the claimant's WS beforehand. I can easily just remove these though, as they have no real impact on the rest of my WS.

I appreciate the advice, i'll get it submitted before 4pm tomorrow then  :)

If you are all ready to file then I would probably wait until tomorrow afternoon, I had up until 4pm 13/07/22 to file my WS. This morning I received a Notice of Discontinuance. I really hope you receive one too.
Thanks for the advice, i'll definitely get it filed before 4pm then. That's great news for you, the best outcome really isn't it. I'd love the same to happen to me ideally too. Fingers crossed!

For me, yes, this was the best outcome. I know some people would relish their day in court. But not me. I was so relieved to receive this. Might be worth keep checking your emails and also junk files - just in case.

I wonder if a Notice of Discontinuance could still be issued after you have submitted the WS?

    Good luck.

I completely agree, if I can avoid the court hearing I would appreciate it! I've been regularly checking my inbox and junk the past week or two, so i'll keep my eyes on it.

I feel as though I would have already received a discontinuance by now, if they intended not to proceed. But there's still time (hopefully). I'm sure someone experienced on here could advise?

They may well be hoping you won't file & serve a WS, which makes you look unreasonable and they could then bang one in at ten to four tomorrow.

They can and do discontinue after WS stage! Any time before the hearing.

Don't miss the Public Consultation mentioned in the top sticky thread. It will open soon and even if your case is over like @bloodyccbc you will (I trust) want to help us and all motorists to bang that final nail in the coffin of the added false £70 'court-race and intimidation' funding model.

    Good afternoon everyone  :)

Just a quick update on how things are progressing, as I haven't logged in for a while. I now have a court hearing date for later this month. I've also received the below email today, explaining that UKPC won't be attending the hearing. If i've understood it correctly, is it commonplace for the PPC not to attend themselves?

They hardly ever do, potentially too many awkward questions to answer.

I'm rather concerned that you've not mentioned submitting your WS and evidence bundle, and warning bells chiming on the basis of the Claimant having submitted theirs, and they are notoriously last minute/late in doing so.

Check your Letter of Allocation which will instruct you by when you need to submit yours - possibly on the back page. You and the Claimant have exactly the same deadline to submit.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
