Daughter received four PCN’s

Hi looking for advice please, I have read a lot of the posts regarding parking charges but looking for more help
daughter received four PCN’s from NCP for different dates which she ignored, then received letters from Trace debt to pay these which she ignored, now just received the letters again from trace saying this has now gone to the escalations department at trace who work closely with their clients and solicitors And now will be selected for referral to clients solicitor 
daughter is adamant she’s not paying a single one, but have read that they can take you to court with a CCJ

Any help and advice would be much appreciated

    She is being foolish.  These companies ruin lives.  Tell  her to read the newbies asnd prapare for court.  Read this

    Read the Newbies and understand the system and what the defence points might be.

    What is the alleged contravention? No permit or something else?

    They can take you to Court to try and get a CCJ. There will be no CCJ or Bailiffs until a Judge says so (ie if you lose in Court)

    Yes they can, and with 4 tickets in the mix, she can expect a court claim sooner rather than later.  They'll be pushing for around £1,000, and that mustn't be ignored. 

    NCP have become much more litigious over the past few months.

    If the ignore path s stubbornly followed to its conclusion it ends with court papers served, then if these are ignored a default judgement, then if this is ignored a CCJ and a trashed credit record for 6 years, meaning no phone contracts, car loans, mortgages etc etc.
    Plus if a CCJ is paid off it will still be there (marked as satisfied) ruining a credit score for 6 years.


    It is possible to set a CCJ aside, but not if court papers ( that were sent to a correct address) have been ignored

    Better if you don't just 'drip feed' us information. The more the regulars here know of your case, the better they can look at th issues. For example, how long is the claimed overstay? Best if you can show both sides of one or more PCNs but make sure you redact all personal details

    By how long - a few minutes, or are we talking about considerably longer?  She needs to get her own photos of the signs and what they say. If any parking events were during the hours of darkness, then photos need to be taken in darkness, with flash turned off for some, but left on for others so that the information on the signs can be read. 

    Were the parking events all at the same car park?

  • All same car park and stayed over an hour her time 
    I’ve explained all this to her but as this happened in England and we live in Scotland we cannot get photos

    Does daughter live in Scotland also?  Did you read the NEWBIE sticky where it talks about Scotland being different and there being no keeper liability?  In any correspondence has she given any information concerning the driver?
  • Yes she lives in Scotland but was living and working in England when this happened now she is back home in Scotland 
    she has not even acknowledged them once but it’s getting a bit scary now they’re mentioning court
