    Your employer is legally obliged to process the attachment and make the specified deductions, they do not have a choice. The only thing that might factor in is if they received it in time for it to be processed on the January payroll. If you are due to be paid on Monday that payroll would have been processed and submitted last week, so it has either been actioned or not, they won't be able to do anything about it now if your pay date is Monday. You can say what you want but unfortunately with an attachment you have no say at this stage, your employer cannot refused to make the deductions, the only question is if they received it in time for this pay run.

    When are you next due to be paid and when will you receive your payslip? That should detail and deductions. As you have now raised this as a fraud complaint it would normally be suspended before the next pay run, but that would take a couple of weeks so will only likely be actioned for a pay run at the end of February.

    Slim to no chance of a fraud case being investigated by DWP being completed in that time frame.

    But I suspect that's not really what you are interested in.

    The question is, is there possibility for them not to find the person and to make me paying the debt?

    There is almost zero chance that the fraud case will be resolved by the end of February, it will likely take months. They should however suspend the attachment to earnings while the case is being investigated, meaning that no deductions would be made from your salary until and unless they found you were liable. 

    Be prepared for this investigation to take up to a year to resolve, but also keep in mind that it should have almost no impact on you whilst it is ongoing, although they may ask you for a few details, ID, confirm where you have lived, bank details so that they can confirm that the account was not yours etc.

    Thanks. When I spoke to them they said it can be solved in couple of weeks. Might call them again to find out if the payment will be suspended.

    That is quicker than I thought as from previous experience when trying to help friends and family the DWP move slower than a dead snail, but it is hopeful that you can get this resolved and it will not drag on.
