  • As Elms appears to be basically a one-man band, its very strange that they have TWO Phoebes working there.
    Perhaps Phoebe Grundle got married over Christmas or changed her name by deed poll to Robbins...
    Or maybe Ed identifies as a Phoebe now and then but forgets his surname. Idk.

    I've finally had my Notice to small claims hearing letter. 

    First line reads - Deputy district judge martin has considered the statements of case and directions questionnaire filed and allocated the claim to the small claim trackIt then lists a load of instructions. 

    Hearing dated for 27th May. (It says the claimant must pay court fee of £27 before 29th April).

    p.s I still haven't received any correspondence from vcs regarding my SAR request, what should i do about this?

    Did you email the right place for the SAR?  The DPO email of VCS, on their privacy page?

    Yes I sent to the DPO email on VCS privacy page (dataprotection@vehiclecontrol.co.uk) sent this on 28/01/22 and I've followed up to the same email on 8/04/22 with no response again. Is this something that I can discuss with the court beforehand as I don't have any information or correspondence to work from?

    I'm still following the info from Newbies and Bargepole.

    I don't think the court will be too interested, but I suspect the ICO will. Immediate complaint to the ICO.

    (The email address you note is still correct per their website - makes sure you didn't make a typo though).

    Hi, Im Just sorting my evidence and witness statement, and would appreciate some guidance if possible. ive attached the newbies list of evidence below as reference. I'm not really in the right frame of mind right now to pursue this as ive just lost my dad and had my first child both in the last month, but dont want a ccj. So I would happily just post the video of me driving past the signs at JLAirport abnd my witness statement, obviously lose and just pay the fine with no ccj. So if anyone can help me do anything better than this Id appreciate it.

    (a) - do I need to show a copy of Beavis case sign? the signs at JLAirport are completely different. 

    (b) - ive read that the sign states about entering a contract, and that we cant actually accept a contract as the writing is small and we cant read it while driving. but there is no contract info on the sign at JLA. should i still screen shot the sign and send it as evidence?

    (c) - I have recorded a video driving along the road showing that you cant read all the information on the signs.

    (F) - on parking prankster law page, there are obviously loads of cases. how do i find the ones that are relatable to my case?

    (g) - what are the IPC or B{PA code of practice?

    (i) - where is this info and is it relevant to my stopping case at JLA?

    (a) a copy of the Beavis case sign as a comparison to show how awful the small print sign was in yours case (see Google images - it's yellow and black)
    (b) photos proving the scarce/illegible small print signs & a view showing the lack of entrance signs, etc.
    (c) maybe a video of how it looks from a car? Get a passenger to hold a camera or phone and record the lack of signs in similar light conditions.
    (d) if you are defending as keeper, not driver, include a copy of Schedule 4 of the POFA - there is a link in post #1 above. Plus a copy of Henry Greenslade's wording from the POPLA Annual Report 2015 'Understanding Keeper Liability'.
    (e) a copy of your lease or tenancy agreement if this is an 'own space' or 'block of flats' dispute where YOU have primacy of contract.
    (f) case transcripts that support your argument (get them from the Parking Prankster's case law page), e.g. if arguing prohibitive 'forbidding parking' signs which offer no contract a driver can accept, you need PCM v Bull; if arguing that this is a residential space where the tenant/leaseholder has already been granted the right to park or unload, you need Jopson v Home Guard (appeal) and PACE v Mr N, etc.
    (g) the IPC or BPA Code of practice, where it supports your case (e.g. grace periods) but be sure to use the RIGHT version for the date of parking.
    (h) Pay & Display ticket, if the driver paid. DON'T argue 'no loss'!
    (i) the Approved Judgment from Southampton, plus paras 98, 193 and 198 from Parking Eye v Beavis copied & pasted onto a single sheet.

    I don't think there are useful cases about LJLA in that page of transcripts so don't bother with that in your case.

    Yes, ideally put the yellow and black Beavis case sign next to the VCS sign as a comparison of clarity and prominence.

    The IPC code of practice relates to VCS, not the BPA one.  But not sure there's much of use in it for you!

    Why not copy from a WS someone recently wrote for a winning LJLA case, by searching the forum for the most recent ones (March/April).

    A good example of what a WS and evidence looks like (but I think it's not a LJLA case) is that by @wobs2k

    P.S ...last but not least, I am so sorry to read about your Dad.  Sadly, I've been there, done that with far too many close loved ones, not from Covid but other things. Life is unfair and the best can be taken too soon.
