Thanks for sending that. I’ve taken a read and sent a complaint to them through email.It was the Legal Team who replied, so I’ve reiterated that it was CEL who sent the LBA, not DCBL, and also asked for the SAR again with data amendment of my address.
I’ve given them 7 days to respond but this is just a response, doesn't have to be the SAR too.
Hopefully my local MP can get things moving once they work my case. I’m waiting a reply from them, shall I let them know that CEL declined my SAR? Or await a reply?I’m out of the 30 days now, but was me asking for a SAR a reply to the LBA?Feel like I’ve done this all wrong now.Thanks.3 -
- Just an update. Legal Team at CE Ltd replied shortly after and said they would action the SAR. They have also amended my address.As I gave them 7 days to respond, they said ‘In accordance with the General Data Protection Regulation, we are given up to one month to respond’.Although correct, I reminded them that this would have to be from my initial request, meaning they had less than 30 days to action it.
As it’s their legal team is responding, I also managed to mention that I’m seeking debt advice and want the case on hold for a further 30 days.3 -
Morning everyone
On the 26/01/2022 CE Ltd provided me with a SAR which was just copies of all of the letters them and DCBL have sent to me.
They did not include machine record payments made that day at to the VRN. I requested this again, including evidence held and the signage.
They have responded today with a picture of the signage and although dated 2019, looks to have the same T&C's. In terms of payments, they have sent me this:
No further details on evidence.
This doesn't show the issues we had calling, I was hoping they would have numbers and how may times they called etc. Seems as though they're sent the fine because I didn't pay within the 10 minutes.
Where do I go from here?
I'm yet to hear back from the MP.

From here ? Depends on what stage you are at !
If it's the LBC stage , then the SAR and 30 days hold notice is it , apart from complaining to your MP , plus the landowner or managing agent
The next move is up to CEL ( to issue a court claim pack from the CCBC in Northampton )2 -

Yes, at the LBC stage. Annoying, as I was hoping for the the payment details to prove we had issues paying! Maybe I could head down to try the same way myself and record it as mentioned earlier.
Fingers cross the MP replies soon. The restaurant never got back to me.2 -

I have great news - I received a letter from my MP who contacted the Chief Executive of CE Ltd and DCBL in request to cancel my fine!He mentioned that because I broke down, I had to pull into somewhere safe to ensure I wasn’t causing dangerous obstruction to the road, and feels it was issued unfairly as the resultant was closed (due to covid) plus it seems ‘totally wrong to fine and pursue debt when there were no means of obtaining the relevant permit’.
He said he would contact me if he gets a reply (email to them was sent on the 3rd and I have received this letter quite late here) but fingers crossed they cancel it!Will keep this chain posted - wanted to thank everyone again for the help.4 -
And that is one reason why Deepy tells people to complain to their MP , especially if it does get cancelled
It's also good evidence for any court claim case , to have something like a copy of that MP letter to exhibit2 -
