It won't matter that you have missed your Defence filing deadline.

The Claimant hasn't sought a Default Judgment in that time, so your recently filed Defence should be accepted without comment. Keep checking your MCOL Claim History confirming that your Defence has been accepted.

If by some stroke of misfortune the Claimant has obtained a Default Judgment since lunchtime today, complain bitterly to the CCBC with the proof that you filed your Defence on time the first time, and that proof being forwarding your Defence again - this time forwarding from your email 'sent' folder so that they can see it was earlier sent on 9th January.

Thank you, my MCOL Claim History now has an update "Your defence was received on 08/02/2022". So perhaps it is accepted as you have said.
  • So its been over 7 months since I submitted my defence, the last update I have had is 'Your claim was transferred to _____________ on 21/04/2022'. Uk Parking Control Limited still emails and sends me letters to settle at a reduced fee. Any chance I will get a court date, or is it possible the case will get thrown out? This ticket is from 2017, I cant believe its been 6-7 years....

What's the missing bit - is it the name of your local court, or something else. No need to tell us the specifics, but give us some idea of what it is.  It could be anything as it stands - I guess it's not 'your local chip shop'!

    Maths check!
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Yes, it's the local court, my bad.
  • I have finally received the 'Notice of Allocation to the Small Claims Track (Hearing). On the letter, it says the hearing will take place on March 2023, but that I must deliver to all parties and court the documents I will be relying on no later than 4 pm on 5th October. Is this normal?

How much of the example witness statement on the newbie's section can I copy, it seems like a complicated stage. Or am I overthinking it?

Your advice is greatly appreciated as always

Normal or not, if that's what it says, then that's what you must do.

Keep following the guidance in the NEWBIES thread.
Do not miss any deadline dates.

None of it.  That's an old example, now superseded by 2022 versions.  See any other claim thread from 2022 where a WS bundle has already been done.  We have hundreds.
