C-m, I’m my time away from this forum I’d forgotten about your fine ways.
    I’ll put something together
    tomorrow.
I’m assuming nothing will come of
it but will be a great defence
    addition?

I think they might give up if you make your response as robust as I suggested.

If not, defend and definitely do a counterclaim.

Just to pick up on a point (which you're not including in your response anyway) ... Cause of action estoppel is not about bringing the same claim again (which is how you wrote it), it is about bringing the whole case (i.e. all PCNs) in one claim (where the facts are the same/very similar) rather than drip-feeding claims through the court. Therefore if they tried to bring another claim against your wife for the same location then it should be estopped as they've previously failed in a claim against the same defendant. :)

  • The question is, did DCBL know this or is it UKPC just sending them any old parking ticket in their desperation to collect money.

Maybe DCBL don't understand that this could lead to more egg on their faces, just like VCS did, and it cost £1000 in compensation.

The whole industry requires a brain transplant

Thanks Jenni, I will pin this in case they have the neck to come at us again once the latest debacle is done and dusted.

What’s the VCS reference please? Twice it’s been mentioned now…?

Should I address that one of the tickets that they are claiming for is for not parking in a designated bay, whereas the other is for none display of permit (as we’re all 5 of my wife’s) Or just fire off your suggested response and ignore it at this stage?

I saw that but it's not important right now.  Just fire off what I said to try to stop this entirely.
