On the court claim it states "The Driver agreed to pay the penalty in 28 days and did not"Trainerman said:
How can this be true when they didn't know who the driver was.The allegation is that by parking the driver agreed to the terms of the contract. Those contract terms are the terms on the signs.Almost certainly there is a term on the signs stating something like "if the driver doesn't park in accordance with the rules then he agrees to pay £nn within 28 days...".1 -
I've got a copy of the original letter. It is Re: note to keeper.KeithP said:maycowan said:

Underneath it says "we do not know the driver so we invite you to pay or provide us with the name and address of the driver so that we can write to them"
Is that of any help to me0 -
Also somewhere on this forum when writing my defence I was advised to write words to the effect of that I did not enter into any contract.maycowan said:

And if you weren't the driver then of course you didn't enter into any contract to park.maycowan said:

As I said less than twenty minutes ago, the allegation is that by parking the driver entered into a contract to park.1 -
Thank you and I know I must come across as being a bit dim but my anxiety is through the roof with this so I'm not always grasping things as quickly as maybe a younger more rational person so I am very grateful for any help and guidance given.KeithP said:

Ok @maycowen , I want to go to the end of the story before anything else. I stand ready to be corrected by the real experts on here, but I want to address your anxiety. What is the worst that can happen? IF it goes to court and you lose, you might well get the fake add ons removed, so the bill will be smaller anyway.
THEN you make a choice. If a CCJ is a problem, you might choose to pay. If a CCJ is not a problem you will probably be able to pay in instalments . From reading your story, it probably will not be much of a problem even if things go wrong ( and we do not intend that they will). So that is the worst that can happen. You will get a bill that you make arrangements for, no criminal record, no jail, nothing to really worry about. So try not to be too anxious.
Can you show us that photo of the PCN/letter after covering your name address and car reg?The pen is mightier than the sword ..... and I have many pens.2 -
I hope you can see this

There must have been a letter before that one. Can we see it, both sides please? Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
