hi, sorry in advance, i am new to the forum. i have read the newbie post but still don't understand what I should do....
i have received a claim form , in the County Court Buisness Centre.. from an incident oct 2019
so, my wife had an important appointment at Plymouth hospital for a brain/eye stress test due to her failing eyesight.
we decided to stay in Plymouth that night and drive home in the morning.
the travel lodge did not have its own parking and as it was 9pm on an October night we parked at the private car park opposite..
i phoned the number and paid for 12 hours parking..
as my wife needed to use wheelchair we parked in a disabled bay and put the blue badge in the windscreen.
however the car park was so bad with potholes we were forced to walk, so I put the wheelchair away whilst my wife took her crutch from the front seat...
in the morning there was a parking fine notice on the windscreen and I noticed the blue badge was not in the windscreen but on the front seat, my wife must of knocked it getting her crutch out of the front..
we took a photo of the disabled parking area before we left as there we no signs there saying a blue badge must be displayed...
they now say we must pay
Amount claimed £175.46
Court fee £35
Legal representatives costs £50
Total £260.46
do we pay or fight it in court

Date of Issue shown on the N1 Court Claim form please?
Have you acknowledged service (AOS)? If so, on what date?
Have you sent a Subject Access Request to the parking firm? Which parking firm is pursuing you and which solicitors have they instructed?

hi, thankyou so much for replying...
it was over 2 years now and was quite a stressful time, my wife is also a long term stroke sufferer (had stroke at 26yo!)
I'm not 100% sure wether we tried to appeal it at the time or not...

You need you need to acknowledge the service of the claim form on you. AOS = Acknowledgement of Service. This needs to be done by day 19 after the Date of Issue. However, don't do it until after day 5. Forum regular contributor @KeithP will be along soon to give you a clear timescale and a list of actions to set this ball rolling.You need to do a SAR to PPS in order to determine what information they hold on you and your vehicle. The NEWBIES FAQ Announcement, second post, provides a link to a template for you to use. Get the SAR done today - they have 30 days to respond, so the sooner the better.Please note, we are not a legal advice forum. Send the SAR by e-mail to the DPO of the PPC (all acronyms are in the NEWBIE sticky) and the address for the DPO can be found (usually) on the privacy page of the PPC's website.
