    Why on earth would you pay them to park in your own space?! Not having a go or anything but it's that sort of attitude that keeps them in business. They have likely offered those terms knowing they will fall at the next hurdle.

    Thank you. I am just concerned as I already did complain via my property management co. and this seems to be their response/best offer. Would you advise me complaining to them again? In your situtation how was it ultimately resolved? Did you have to go to via the court process? What was the step that worked for you? Again, thank you for taking the time!
  • Sounds like a big misunderstanding to me
    You'd think, wouldn't you. It was PCM who issued me the permit too- they are literally managing the whole set up ("scam").

    Noted, thank you. I am just a little overwhelmed at the amount of stuff on here to read and get to grips with, and doubting my ability to involve myself in anything more complex than basic letters and evidence. The legal jargon is a lot.
  • If this is useful in any way this is the response from PCM to my property manager:

    I have review the case, in black and white terms the driver has parked without a permit therefore the PCN issued are correct. It would appear that the driver hasn’t returned to their car since the PCNs were issued, therefore I am willing to cancel the later 3 PCNs if the first two are paid.

    Current total: £300

    Offer total: £120 

    The parking scheme is in place, in part, for the benefit of residents. By accepting the permit and taking this benefit (i.e. having their bay managed), one must accept their part to play – display their permit and park within the appropriate bay.

    Generally speaking, parking enforcement must be approached in a universal manner. The T&Cs must be applied equally to all motorists, otherwise the scheme becomes unworkable.

    If the resident would like to accept my offer, please let me know once they have paid the first two PCNs issued. This offer will be valid until Monday at 5pm only. If they choose to appeal further the offer will no longer be valid. The PCNs are not on hold.

    I’ve just posted my experience of the whole PCN debacle on this forum as a new thread, sorry just joined & don’t know how to post the link but hopefully you can find it as it explains what I went through.  The parking company are just trying it on, that is ultimately how they make money. Go back to the property company - quote the clause that references your right to park and ask them to confirm where in the lease it specifies you must display a permit / liable for any fines. If there is no reference in your lease, then you are not liable to pay anything.  I would also quote your right to quiet enjoyment which will also be included in your lease and say that the issuance of the PCNs is in breach of that.  Your property mgt co simply don’t care as mine were the same but they have a responsibility towards the leaseholders so don’t let them get away with it. I wrote a 1 star trust pilot review which is how I got them to take it seriously and wrote an email of complaint.

    We have always had parking permits, but the system was more sloppily managed previously- but PCM just overhauled it and issued these new permits to everyone in July (including the ones that are specific to numberplates), and I think installed new signage in the car park. So it seems to be part of a drive to clamp down on parking.

    This isn't a misunderstanding, this is the standard IPC parking firm nightmare you residents live with by not objecting to these notorious ex-clampers being inflicted on you.

    Resolve to kick up a stink with the backing of your MP and get them out this year and NOT replaced.  None of you need any permit scheme.

    I tried to find out from the property management company whether they pay CPM for their ‘services’ but they didn’t respond.  Does anyone know how these companies operate? I did look at the service charge statement but couldn’t see a line item covering this or do they simply make money from people paying PCNs?  

    I am planning to follow up with the directors to see what can be done to remove their services but I’m guessing there will be little appetite as most residents have no idea how they operate.
