Please make sure that any copy and paste excercises are relevant to your case  -  for instance para 33 states IPC CoP
Shall I attach IPC CoP as an additional file then or try to change the paragraph and stick to BPA  / DLUHC ?
Is it a BPA firm?  Then don't use the IPC at all.

I wouldn't use the close up of the red sign.
I didn't know they need to be a part of a body like BPA.

Checked - YES, they are a part of BPA - changing par.33 now

That's a Witness Statement you have shown us but the Statement of Truth starts...
I believe that the facts stated in this defence are true.

Your Statement of Truth needs to be far more comprehensive.

    Something like...
I believe that the facts stated in this Witness Statement are true.  I understand that proceedings for contempt of court may be brought against anyone who makes, or causes to be made, a false statement in a document verified by a statement of truth without an honest belief in its truth.
I don't understand now is it just one sentence as it is mentioned in the Notice of Allocation: "I believe that the facts stated in this Witness Statement are true."

Or as you previously mentione to make it far more comprehensive?

    I stand by that.

Today at 11:29AM you had written at the bottom of your Witness Statement...
I believe that the facts stated in this defence are true.  I understand that proceedings for contempt of court may be brought against anyone who makes, or causes to be made, a false statement in a document verified by a statement of truth without an honest belief in its truth.

I was hoping you would read what I wrote.
I was only pointing out that the first sentence of your Statement of Truth was talking about a Defence but it should of course be mentioning a Witness Statement.

I was only commenting on the first sentence of your Statement of Truth, but you appear to have now replaced the whole thing with just that one sentence. That isn't right.
  • Hey Keith, Thanks! I didn't see you point before indeed. It was mistakenly put this way, now corrected.
Thank you for going through the whole thing.

I did add one photograph more in paragraph 7 - just to be more precise.

Last importand question before posting my WS is:

Do I need to attach any copy of previouse judgements of similair cases like for example jrhys did?:

Looking into WS of jrhys I can see there is an exhibit - a Copy of Excel Parking Services vs Wilkinson (G4QZ465V) Approved Judgement by Judge Jackson of Bradford County Court.

Shall I insert regarding to my case Beavis case judgement photos? Is it necessary? Or is it enough what I put in WS and what was written in the Defence?

Why are you wanting to post a WS?  This is usually now all done by email, copying in BW Legal.

You can add in Excel v Wilkinson if you want but the new Code of Practice is pretty damning about the added costs, as long as you've fully explained that.  You could do both.  Add a sentence copied from jrhys' WS, explaining about the transcript.

The NEWBIES thread tells you some ideas to use as evidence with a WS and one of them is indeed the yellow and black Beavis case sign, to show what a clear and brief parking sign looks like, in 'warning' colours.

I want send my words of thanks to anyone who have helped actively or passively in my case and in particulair to:

KeithP,Coupon-Mad,D_P_Dance,Le_Kirk and irhys for sharing WS with me.

The case is going to be closed now as I have just received a reply to my email from the claimant that they decided not to continue with the case, and apparentely sent a letter few days ago to me and to The Court.

Anyone has any questions feel free to ask. I am going to redact last document (Whitness Statement) so anyone in similair position to mine can benefit from it.

I have received a private message already from one taxi driver having similair issue and I'm glad my case could help little bit. As the question was related to a defence, I am going to post mine over here and to summarise the proccess of the dociumentation being prepared so people like me who have problem with preparation of officials letters will find some help.

A big thumbs up to the Guys for running this forum so activlely.
Well done. If it was not only a virtual place I would have already invited you for a drink.

Tkank you again to everyone, ... ohh yes almost forgot.... thank you to people who were sharing stuff and I was able to read it through.

A special thanks to Coupon-Mad for how small and how big support, in the moment when I completely got stuck  reading Newbees post allover again not moving forward at all drawning in doubts and hesitation. But this is already behind and I am very very greatful and very, very happy now.

If there is any conference/ meet up etc you are organizing plese let me know. I will def show up.

I meant sending an email - wanted to be clear my deadline was there ( my english is not as fluent as you could see by now lol).
Just out of curiosity - maybe other people could benefit from this question - does a new code have a power over cases that occured 2/3 years ago?

P.S.I need to go through this damn 50 pages long newbees post - I am over now but still don't get where is a defence part and where WS starts lol   😂🤣😂
