If the company number on the contract is different to that of the company listed on the signs and on your PCN, then that is absolutely relevant - the company chasing you for payment have no contract to operate at that location. :)

If they argue that the company operating is a subsidiary of the company with the contract, where is the proof that the subsidiary has such authority? (Bear in mind that they can't hijack you at the hearing with such evidence). Maybe this is one for your crib sheet rather than submitting a SWS. ;)

    ...what is a SWS?
    SWS = Supplementary Witness Statement.

This is the agreement between Callmount ltd and Britannia Parking services ltd company number 8187238.
My PCN is from Britannia Parking group ltd company number 08182990
They both have different addresses one in Bournemouth and one in Poole.

Two entities with different company numbers. Neither can be claimed as "trading as"

Before covid, I was in court helping a member with the same scenario. It was BWLegal representing Britannia using a "rent by the hour" rep

After the rep said his piece, it was pointed out to the judge about one Britannia entity who issued the claim and the Britannia entity who issued the parking ticket.
We did not have a landowners contract as you do

The Judge just looked at the rep BWL had sent and said "do you know about this"  ...NO SIR the rep said
The judge dismissed the case and awarded £95 costs

What I did not know was that at about the same time, the Oxford court did the same to BWL/Britannia for the same reason

The question now is will BWLegal continue knowing that a spanking will be on the cards with costs awarded

So they are still doing this!  Signs not necessarily displaying the same company number as the NTK, and so-called landowner agreement with a dormant company.

In the case mentioned by @patient_dream
their WS included copies of the NTKs, all carefully cropped at the bottom to remove (hide?) the company number normally showing in the footer.

    Read about it here:

Useful wording you can copy & use.

  • It took me awhile to convert this, but here is the Claimant evidence i was sent. Hopefully i have removed anything mentioning my details. Anything else blanked out is by BWlegal. I forgot to include the Contract agreement 1st page, but that is shown earlier in this thread.

How long do i have to prepare a SWS? Do i email the court and send it to the claimants?
Other than expalining the customer numbers don't match, is there evidence/an example to refer to where it resulted in the defendant winning a case?

    thanks for any advice.

    Good!

You are possibly late to send a SWS so do it THIS WEEK and keep it concise.  When's the hearing?

Be more robust - but concise - in your SWS and get the terminology right (for example, this is wrong):

    "the customer numbers don't match"

is there evidence/an example to refer to where it resulted in the defendant winning a case?
Yes, the case i gave you and I think Icleboy provided his claim number, court and hearing date.  If not, @patient_dream has it.

YES, the thread by Icicle_Boy is real and he won.

It was coupon-mad who spotted the 2 entities and it carried on from there

Icicle_Boy emailed BWLegal about this and also for an explanation of the fake add-on

BWLegal ignored the email and did not advise the "rent by the hour" legal .... hence the judge asked if he knew of this.  Icicle_Boy showed the email BWL ignored to the judge.  The judge raised his eyebrow and turned to rep and said .... "this is not going well for you, is it ?"

The judge then dismissed the case, awarded Icicle_Boy £95
