    I don't understand your question but none of these deadlines matter.

    The store manager can cancel this in 2 seconds flat and the BPA will also agree with you if it is a double dip scenario and will come back to you this month.

  • how do i get the manager to cancel it when they have a person set up with a procedure to appeal? i can not feel that i am going to be fighting an uphill battle against an authority that has no issue with lying. sorry if this sounds weird but my frame of mind is falling apart. my mental health issues are screwing with my thinking straight.

    They are not an authority they are scammers  I feel that you are overthinkng this.

    You are not up against an authority.  Relax.

    Of course the BPA and/or Store manager can see this cancelled in two minutes flat.

    Why not follow up your BPA complaint reminding them that this is about a double visit and their member MUST cancel it, but that this farce is causing you severe anxiety and you already have poor mental health.  How dare a BPA member wreck your peace of mind like this.

    Say that.

    And if you are not strong enough to say that, ask your MP to say it in writing, to the BPA and B&Q and the parking firm, on your behalf.

    Please don't reply saying this is too trivial for an MP to be interested.  Far from it!  There is a new law coming in to regulate this rogue industry.

    I got onto the BPA and they told me to appeal so I did. I sent off the template provided from NEWBIES and they came back with:

    We write to acknowledge receipt of your recent online appeal, on behalf of the driver, appealing against the issuing of a Parking Charge Notice (PCN) to the vehicle.

     

    We note your comments and must refer you to the Protection of Freedoms Act (PoFA) 2012, Schedule 4 - Recovery of unpaid Parking Charges. This is available to view online at:

    http://www.legislation.gov.uk/ukpga/2012/9/schedule/4

     

    We now therefore request that the details of the driver of the vehicle at the time of the contravention are supplied; this must include their full name and serviceable postal address.  If you are unwilling or unable to provide these details the registered keeper of this vehicle will remain liable for this PCN.  This information should be provided by 11th November 2021.  Please note, Premier Park Limited will not reply to any correspondence until after the above date, if the requested information is not provided.

                                                

    If we do not receive this information by the above date, the appeal will be formally responded to and we will hold you liable as the Registered Keeper of the vehicle on the date of the contravention.

     

    Please note if we receive correspondence from the driver at the time of the incident we will not respond to you further on this matter.

    I think that they want to start something else now. What is the next move please. I worry that if I send my name they will come after me a different way which I think was mentioned earlier.

    Question , did PP comply with POFA ? Yes or no ?

    The newbies FAQ sticky thread near the top of the forum in announcements tells you how to check

    If they have complied with POFA , then the driver details can be revealed , if not , the keeper is not liable but a driver is , or can be

    I would have added a line to the blue text template starting that

    The driver made 2 short visits that day and your anpr cameras are faulty , this is clearly a case of double dipping which will be mentioned to Popla as well as a complaint to the BPA

    Not saying the above is one reason for their reply

    So did PP comply with POFA ? Yes or no ? ( POFA is the law that can hold a keeper liable )
  • I have no idea what to do here. I am going to say that I was the driver and give my address. 
    I cant make head or tail of what the hell that legal crap is supposed to mean. The letter the premier park people sent said, they requested the keeper details from the dvla through reasonable cause of pursuing an outstanding parking charge notice. Then says if I was not the keeper of the vehicle at time of parking, or if the vehicle was stolen prior to the beginning of the parking period to let them know. Then, if I was not the driver to supply the name and address of the driver so the liability can be transferred.

    You haven't answered the question though , they have mentioned POFA , so is the NTK PCN POFA compliant ?

    If yes , name yourself as driver ( if true ) and state that 2 short visits were made on the same day ( as I said earlier )

    An appeal should give the grounds for appeal , which is the double dipping etc , especially if PP complied with POFA

    Learn to follow instructions and provide useful feedback , especially when you ask for expert advice

    If you are going to drive a vehicle , then the legal Cr*p comes with it , so you cannot ignore your legal responsibilities

    You might want to reconsider your decision.

    If the parking company don't know who was driving then they need to use the facilities of Schedule 4 of the Protection of Freedoms Act in order to transfer any driver's liability to the keeper.

    If, usually through incompetence, they cannot transfer the driver's liability to the keeper, then they have no-one to chase.

    Whilst you telling them who was driving might seem to be the simple way out, you are handing them your head on a plate.


    I would suggest you do not respond to that letter, but instead wait for their formal rejection of your appeal.
    Then as @Redx says, you can appeal to PoPLA and win.
