UKPC CCJ - URGENT HELP NEEDED FOR RESIDENTIAL CAR PARK - FINAL DEFENCE NEEDS PROOF READING PLEASE

Hey everyone,

I have been hit with an outrageous figure (over 4K!!) from various UKPC parking fine's (from early 2016) I've been following the newbie thread but really need some help writing my defence, I have sent my Acknowledgement of Service and have kept in good contact with the courts and they have advised I have until the 12th to filed it. (p.s I am dyslexic so if you see spelling and grammar mistakes do flag and I will correct.)

ANY help is massively appreciated

    CCJ or MCOL court claim ??

    If it's the latter , from the CCBC in Northampton , then its a Court Claim , meaning that there is no J ( Judgment )

    If it's a court claim , post your issue date from the claim form , top right , below

    Use the defence template by coupon mad

    So I am hoping that it is not a CCJ , yet ( no judgment )

    There is no court yet either , if it's from the CCBC in Northampton ( it's a government office ) , court comes later , in a few months time

    Its a CCJ I believe - Issue date 09/09/2021

    If I'am honest I do not understand a lot of the language being used on the template and would hate to get myself into a muddle in court haha but I will try my best to use and understand, so if I am right I need to adjust the template to my case?

    If you have filed  AoS, it is unlikely that you have a CCJ more likely a claim form.  Please scan or photograph the papers (take out ANY personal information) and post it on here.  Does it say Claim Form N1 or is it a Notice of Judgment or Order?

    It's unlikely to be a CCJ , it's not had a Judgment , so it's a C C , Court Claim , plus they gave you a deadline and the AOS has been done ( whate date was the AOS done ) , so it's a court claim , not a CCJ !

    Put the term CCJ out of your mind , it's not happened so not true , not yet

    Yes adapt paragraphs 2 and 3 and post just your changes below , leave the rest of the template alone , no tampering with the rest

    So give us the 2 dates below , then your proposed paragraphs 2 and 3 below , not the rest , it's your homework being checked

    Have you emailed a SAR to the DPO at UKPC yet ?  Yes or no. ?

    How many PCNs are they claiming for ?

    Right, (breathe) thanks for that!

    I sent the AOS (by email) on the 23rd Sept and called the court today and she advised me I have to have my defence in by the 12th October.

    I have not emailed anything to UKPC yet, should I (look up what a SAR is) and send this ASAP?

    PCN wiseeeee.... I believe 19 on the particulars (2 of the dates on the particulars are doubled for some reason) I will double check when I get home and am with the form (hour or so)

    I'll get on editing those paragraphs now!

    Upon what date did you file an Acknowledgment of Service?
    Your MCOL Claim History will have the definitive answer to that.

    For the moment I am going to assume that you filed an AoS sometime after 13th September and before Wednesday 29th September. Please confirm that date. 

    With a Claim Issue Date of 9th September, and having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Tuesday 12th October 2021 to file your Defence.

    That's well over a week away. Plenty of time to produce a Defence, but please don't leave it to the last minute.
    To create a Defence, and then file a Defence by email, look at the second post in the NEWBIES thread.
    Don't miss the deadline for filing a Defence.

    Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.

    Hey Keith, thats correct I have until the 12th October to file it, I'm jumping on this right away.

    Thanks for the useful link on that, I will file my defence via email not via the MCOL website.

    I will take a picture of the form when I'm with it (within the next few hours) and post it on here.

    Read or better still print the acronyms in post 5 of the newbies FAQ sticky thread near the top of the forum in announcements

    SAR & DPO are explained there , add an unredacted picture of the claim form to the request too , as proof of I D under the GDPR law to obtain all your data
