That looks okay to me. Like I said above, you have to send something and in your current circumstances I think that is probably the best you can achieve within you timescales.

You will be able to expand on all your points at the Witness Statement and Exhibits stage that comes later in the process. As long as you have brought up a defence pint, no matter how briefly, you will be able to research and build upon that point before the court hearing.

When you have time, build on the information you have accrued from everyone who has contributed to your case, and complain to the landowner when you have more time. It is never too late to get a landowner cancellation until the hearing itself starts, so keep at it.

Your last draft says the claimant had no right to obtain your personal data. That opens the door for you to make data breach complaints and expand on it at WS stage at a later date, so I don't believe you need to add anything further on that subject.

Fire your defence off, enjoy your day out with your kids and take a break once you have confirmation that the defence has been received, then come back and renew the fight afresh.

I'm in a similar situation and have raised a formal complaint against Liverpool Airport. Their response advised that all "appeals" should be sent to VCS. I went back saying it is not an appeal, it is a complaint. They then advised "We are sorry we are unable to assist directly with enquiries relating to Red route and Vehicle Control Services". This is not the case...In their contract with VCS under the section "The Companies Rights and Obligations” Point 3.8" it states Liverpool Airport Ltd. are allowed to directly intervene and can instruct VCS (in writing) to cancel PCN's where appropriate.
I am still waiting for their further response and have my MP on board for the next step, which is direct escalation to the Commercial Director of Liverpool Airport.
  • Response received...LJLA Customer Service have now escalated the complaint to their Commercial Director.
It will be interesting to see what happens if VCS are instructed to cancel the PCN...there isn't a valid one in play.
  • Great. Keep the pressure up. Remind her my SD's Notice was unsafe and legally unsound, so logically and legally yours is too.
  • I'll have another attempt at contacting the airport to complain about my two PCN's from 2018 - should I use the POFA relevant land paragraph or do I need to mention their jurisdiction only applies to car parks? I'd like to make their commercial director aware of what VCS are doing!
  • I've copied in jameswhittaker@peel.co.uk as Chairman too. VCS are breaching LJLA's parking Ts and Cs. By allowing that to happen, LJLA may be entrapping motorists - an offence too.
