parked on white line, bought ticket correctly, left within time. court letter issued.

Hi, december last year, i parked in a car park controlled by premium parking logistics. i paid correct fee, ticket displayed correctly, and i left before ticket expired. the mistake i made was that i parked my car with my tyres on white parking bay line. however my car was parked at last parking bay at the end, and no other cars could have been parked there anyway. so i was given a fine. i ignored the fine and didnt pay. i ignored all the letters came (i think 3-4 letters came). today i received a letter from court - county court business centre, nottingham, parking company claiming £250.
can someone please tell: do i have to pay it, or do i stand a chance in defending it.??

You can defend it , by reading the 5th post in the newbies FAQ sticky thread near the top of the forum in announcements , followed by the second post in the newbies FAQ sticky thread , followed by the defence template by coupon mad , in announcements too

That template forms the basis of your Defence

    It's not a fine , it's a parking charge notice , or PCN ( an invoice )

The CCBC is located in Northampton , not Nottingham

Your Claimant parking company name is incorrect , most likely to be Premier Parking Logistics or similar name

What is the total amount claimed ?

Is it via Dcb legal or b w legal ?

Post the issue date from the claim form , top right box on page 1

Of course you don't pay it and if you read the 2nd post of the NEWBIES thread you will know what to do and that we help people win, with no CCJ risk.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • Dear RedX, Coupan-mad, Thanks for replying.

yes, it's a parking charge notice , or PCN ( an invoice )

yes, the CCBC is located in Northampton , not Nottingham. i misread it in the anxiety of getting a court claim (first time i received such a thing and really worried)

Yes the Claimant parking company name is incorrect , it is "Premier Parking Logistics"

    Total amount claimed is £250.76

    it is via Dcb legal

the issue date from the claim form is 23 Sept 21.

As you adviced that i should read 5th post in the newbies FAQ sticky thread near the top of the forum in announcements (is it this one :County Court Business Centre Claim & Civil Enforcement.),
followed by the second post in the newbies FAQ sticky thread (is it this one:**NEWBIES!! PRIVATE PARKING TICKET? OLD OR NEW? **READ THESE FAQS FIRST!** Thankyou!) , followed by the defence template by coupon mad , in announcements too.

I am really sorry but i am not a very educated person/ not so intelligent to understand the legal / law wordings, letters that well. i tried reading all that but most of it is i do not understand.
someone misguided me that i should ignore the letters and PCN as i paid the correct fee, left before the parking ticket expired and was told that parking company will send 3-4 scary letters and then they will stop chasing. but its clearly not the case and they have send me the court claim. i am worried.
i will really appreciate if you can please help me, explaining in as simple wording as you can.
Would you like me to attach any pictures of how the car was parked or any other picture (after editing the identity, reg plate etc)?

Read the second link above ( so not that first one about CEL ) and scroll down to the fifth post , it has all the abbreviatiobs explained , print it out , or copy and past it , then read and follow the second post in that same discussion thread too , then read the first post in the defence template discussion thread by coupon mad , which is the top of the first page in that long thread ( the rest of it is hijack posts , so only the first post on the First page of the Defence template thread

So 3 posts to read by Coupon mad , not that CEL discussion thread

Whoever told you that the letters will stop is a fool !!  Don't listed to fools 🤔🤔🙃🙃

No pictures for now , get the basics done first , reading and understanding come first

Email a SAR to the DPO at PPL to obtain all your data , do that today , with a copy of the claim form as proof of I D under the GDPR law , to get all the documents and pictures , and making them do some extra work

Make sure that you open a government gateway account so you can login to MCOL using the password on the bottom right of your claim form

Don't do the AOS online yet , so nothing is done yet on MCOL

Thanks for all the relevant information so far , I wish everyone would do the same 😁😁👍👍👍

When we say to read the 2nd and 5th POSTS of the NEWBIES thread, we mean the second and fifth replies on the Announcement pinned thread for newbies to read first.

Posts are replies, like I am replying on your thread now.  Yours is a thread and the NEWBIES FAQS is a thread, with several reply posts on it.

Nothing to do with any CEL thread.

    Total amount claimed is £250.76

They have added what appears to be an extra unlawful amount for debt collection. Judges have dismissed an entire claim because of this. Read this and complain to your MP.

    Excel v Wilkinson

At the Bradford County Court, District Judge Claire Jackson (now HHJ Jackson, a Specialist Civil Circuit Judge) decided to hear a 'test case' a few months ago, where £60 had been added to a parking charge despite Judges up and down the country repeatedly disallowing that sum and warning parking firms not to waste court time with such spurious claims.   That case was Excel v Wilkinson: G4QZ465V, heard in July 2020 and leave to appeal was refused and that route was not pursued.  The Judge concluded that such claims are proceedings with 'an improper collateral purpose'.   This Judge - and others who have since copied her words and struck dozens of cases out in late 2020 and into 2021 - went into significant detail and concluded that parking operators (such as this Claimant) are seeking to circumvent CPR 27.14 as well as breaching the Consumer Rights Act 2015.   DJ Hickinbottom has recently struck more cases out in that court area, stating: ''I find that striking out this claim is the only appropriate manner in which the disapproval of the court can be shown''.

the issue date from the claim form is 23 Sept 21.

With a Claim Issue Date of 23rd September, you have until Tuesday 12th October to file an Acknowledgment of Service. Do not file an AoS before 28th September, but otherwise there is nothing to be gained by delaying it.
To file an AoS, follow the guidance in the Dropbox file linked from the second post in the NEWBIES thread.

Having filed an AoS in a timely manner, you have until 4pm on Tuesday 26th October 2021 to file your Defence.
That's over four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.
To create a Defence, and then file a Defence by email, look again at the second post on the NEWBIES thread - immediately following where you found the Acknowledgment of Service instructions.
Don't miss the deadline for filing an Acknowledgment of Service, nor that for filing a Defence.

Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.
  • thanks.

There is an email address on their Privacy Page on their website.
It is the same email address that is at the bottom of every page on their website.
