Failure to complete

  • The mumsnet thread is only 16 posts long, yes much the same response but much less information given by the OP.

    Anyway, all sorted now thankfully.

You don’t seem able to change your mind that it’s my fault. I don’t think it’s my fault at all. Let’s leave it here. I won’t use this forum again! Cheerio
That is a real shame and you'll be added to a long list of people who take the time to post their sometimes desperate situation only to be given a dressing down by a small minority of prolific posters. It needs sorting out.
Being given reality instead  'it's fine hun you'll be ok' is not the purpose of this forum. If you want rose tinted view of things, Mums net is your go to where everyone will tree hug you
    .
Factual information was given and OP didn't like it. Remember who remortgaged in the first place before completion? certainly wasn't us or the solicitor.
If factual information was given in a condescending manner that maybe might be ok. But it wasn't factual. The OP herself has shown it wasn't fact. If it had been given as "I think that..." instead of presented as absolute fact that would be better.

Is it fact that one shouldn't remortgage close to a house sale? And how close is close - how many days before is the cut off point?

So both the message and the presentation needs some work. There's a reason one of the forum rules is to not be unfriendly.

Some urgent issues that need fixing don't need too much wool. They need to be tackled face on because time is short.
The time for identifying fault is once an issue is resolved. If you are facing eviction or a near collapse House sale you need to know how to fix the problem now, law is not particularly emotional there is a 'right and a wrong' answer to a problem.
I am blunt in asking questions at times, but mainly if I post early on a thread and feel there is more information needed.
May you find your sister soon Helli.
    Sleep well.

I'm meant to complete (on both a sale and a simultaneous purchase) on Tuesday, but have just today been told by our solicitors that our previous lender's charge has not yet been removed from the title on the property we're selling. We switched from this lender to a new lender in August (a remortgage).

The solicitor apparently was unaware that this remortgage had even happened. The remortgage was a quick procedure managed by a conveyancer appointed by our broker.

I'm now so worried that completion won't happen as a result. The solicitor emailed at 5pm with no discussion of what would happen if the charge was not removed. They have already received verbal confirmation of removal, but not written. They've been waiting for this since we exchanged, apparently.

Can we complete anyway? If not, whose fault is it, who should we take legal action against for damages?

    Help!
OP, I'm glad you got it sorted in the end.

Responses on the first page of the thread (evening of Fri 24th) identified the two options available.

    1. Solicitor's undertaking - on page 8 (evening of Mon 27th) it was revealed that this had been offered, but rejected by the buyer.

    2. Wait for LR to finish processing the change of charge - this turned out to happen far quicker than expected, and was the solution that saved the OP's transaction.

I very much doubt that this was just by chance. Someone begged the LR to put this at the top of the queue, and the LR very helpfully obliged.
No reliance should be placed on the above! Absolutely none, do you hear?
