    After responding to the LBC as advised above,  do I still need to send another  email to them asking them to put the LBC (incase they proceed) on hold for 30 days as advised on the newbies thread  ?

    They have no obligation to send any acknowledgement of receipt of a Subject Access Request.

    They have a whole calendar month to respond to a Subject Access Request.

    As a solicitor, you should know that by detaching or allowing to remain detached, elements of alleged debts and issuing separate claims, each which rely upon essentially duplicate particulars and facts, this is becomes an abuse of the civil litigation process.  
    This seems to be a half finished sentence.  Did you mean as above, which makes more sense (to me at least)?

    Good evening guys, happy holidays.

    i am back today because the court date has been fixed for the 4th of January. I will be attending in person, Gladstone just emailed me their witness statement, they will not be attending. I need your help please. 
    The court are asking me to send a bundle, I don’t know what that means.
    I have attached court papers and Gladstone witness statements.
    Please help!!!

    You are meant to have done yours.  As the Newbies thread clearly tells everyone "defence is not your only job".

    ...and as the hearing letter or Notice Of Allocation told you.  

    You had the same deadline as Gladstones which was no doubt 'not less than 14 days before the hearing'.

    Now you will have to file and serve your bundle late.

    You MUST do a WS and exhibits or at the moment, the only party who has provided any evidence is the parking firm.  Guess what will happen if you let this stand with no WS bundle from you?

    Adapt the one by @aphex007 IMMEDIATELY and get it emailed to Gladstones and the local court tomorrow before 3.30pm.

    Not to the CCBC at Northampton obviously.

    Thanks @Coupon-mad, the court actually request for the Bundle be sent 7 days before the trial. 
    I will quickly complete one as advised.

    @Coupon-mad I have just read @aphex007 WS, very good. 
    My concern is our case is different. In my defence I claimed I am not the driver also I mentioned that my rent contract did not states I needed a permit to park.
    the Court might ask me who the driver is -not sure what say

    Do you think I have a chance with this defence??? 
  • Please read the notice you posted on the 23rd March. Para 6 requires you to serve your WS no later than 14 days before the hearing. With a hearing on the 4th Jan you should have submitted your WS etc by the 21st Dec at the latest. You must get this done ASAP

    The claimants solicitors must then collate the bundle (your info and theirs) for the court no later than 7 days before.

    Why did you say you were not the driver if you were?  None of our advice tells anyone to do that.  Did you use the template defence?

    If you were the driver you obviously admit that now in the WS.  If you were not, you reiterate that you were not.

    Of course your facts are different than aphex's case; they would be!

    The point is, that you copy the style and the headings, the intro and end section and his exhibits (replacing some of course, with your own photos and lease).
