Dcbl letter before claim stage

    Surely it can't be £237.08 of interest?
    Where is that explained?
    Not sure maybe it means 8% per year interest of when the ticket was issued, so would be around 5 years ago which is 40% possibly.. but then it’s still more than 40% interest.
    I don’t know. I’m not sure where to go from here with it, from the start nothing has ever added up and they’ve constantly changed the amounts etc

    Perhaps they have added unlawful charges for collection. Have you read Excel v Wilkinson?
    You never know how far you can go until you go too far.

    Yes I have, I also quoted this to them but that didn’t stop them taking it to the court stage. I guess all I can do is file a defence and suggest they have added unlawful charges and see what the court has to say.

    Actually, 8% compound interest per annum on £480 amounts to £225 over five years. Horrifying isn't it?

    So what they’re claiming for is right then? I’m starting to think I should of just paid the £480 if I end up having to pay this amount

    Are you joking?  They won't get that interest!  Just because that's the usual calculation they try for doesn't mean a Judge will grant it.

    Traders can't sit on an alleged debt for 5 years in order to make over £200 on it as a reward for their tardiness.

    Your case is no different than any other, this is easy enough to defend and we have a template defence and a walk through all stages in the NEWBIES thread.

    Recently in some cases which PPC have won, judges have been awarding interest of less than 1%
    You never know how far you can go until you go too far.

    Thank you, I have just submitted my AOS, I will take a look at the defence template and come up with something. I will post in here for any advice on my defence.

    The facts as known to the Defendant:

    2.       It is admitted that the Defendant was the registered keeper of the vehicle in question but liability is denied. I do not remember if I was the driver as it was many years ago and I don’t remember receiving any tickets or letters via post. 



     3.  I first heard about these charges this year when I received correspondence, this was around 5 years after the dates on the parking tickets. I have felt harassed by the bombardment of ‘debt recovery’ letters, and  I am also going to point out that the Defendant cannot be held liable due to the Claimant not complying with the ‘keeper liability’ requirements set out in the Protection of Freedoms Act 2012, Schedule 4.

    I do not trust any of the correspondence I have received be it via email or post, I will now explain why. 

    The first correspondence via post was for a total of six pcns- 5 pcns in one letter and one in another. I had noticed in the first letter that they had duplicated two of them and tried to charge me for this. I believe had I not noticed this and pointed it out to them they would have proceeded. Also via email contact the amount owed for the pcns differed to what they said in the letters, the figures didn’t not match nor add up. I believed they were trying to scam as much money out of me as they possibly could, and still are. 

    Also I have now just received another letter- the same letter with the one pcn on but now it has two pcns on it- one extra from a year later in 2017. I do not remember this and because of how they have perused this so far I can not trust anything they are telling me. 



    This is my defence I have come up with, if anyone could advise any changes or anything I may have missed that would be great, I’m not very good at this sort of thing. And obviously the rest is just copy and paste I take it. Thank you
