    Hi this is the latest email from them. I’m not sure if they are saying i owe 4 parking charges- the first 3 they don’t state an amount in this email. Either way I’m not sure how the 4th can be £160 but the other 3 are not, as that leaves £320 out of the £480 to be split between them. Very confusing. Should I question them on how the first 3 total £320?

    We write in response to your recent correspondence received in our office on 15/10/2021.

     

    We acknowledge receipt of this correspondence and we can confirm that this matter (101473.7266D) will remain on hold for 30 days from the date of this email.

     

    101473.5755D 

    Upon review, there are a total of 3 outstanding Parking Charge Notices (PCN). Due to an administrative error, two of the charges had duplicated however this has since been rectified. Please see below the correct PCN details:

     

    • 18/05/2016 - Central House Park Street, Camberley, GU15 3PE
    • 20/05/2016 - Central House Park Street, Camberley, GU15 3PE
    • 19/06/2016 - Central House Park Street, Camberley, GU15 3PE

     

    All of the Charges were issued as the vehicle was parked in a permit area without displaying a valid permit.

    In relation to this matter, there is one outstanding PCN issued on the 17/07/2016 at Central House Park Steet, Camberley, GU15 3PE as the vehicle was parked in a permit area without displaying a valid permit.

     

    In accordance with the appeal decision made on 29th July 2020 in Britannia Parking Group Ltd v Semark-Julien [2020] EW Mis 12 (CC), it is not correct to propose this claim should be struck out as an ‘abuse of process’ due to the contractual costs claimed. You may wish to seek independent legal advice if you are unable to access relevant and up to date appeal information and legislation.  

    As such, this matter will remain on hold for 30 days from the date of this email after which the outstanding balance of £160.00 will need to be paid in full. Failure to do so will result in a claim being issued against you without further notice.

    At the Bradford County Court, District Judge Claire Jackson (now HHJ Jackson, a Specialist Civil Circuit Judge) decided to hear a 'test case' a few months ago, where £60 had been added to a parking charge despite Judges up and down the country repeatedly disallowing that sum and warning parking firms not to waste court time with such spurious claims.   That case was Excel v Wilkinson: G4QZ465V, heard in July 2020 and leave to appeal was refused and that route was not pursued.  The Judge concluded that such claims are proceedings with 'an improper collateral purpose'.   This Judge - and others who have since copied her words and struck dozens of cases out in late 2020 and into 2021 - went into significant detail and concluded that parking operators (such as this Claimant) are seeking to circumvent CPR 27.14 as well as breaching the Consumer Rights Act 2015.   DJ Hickinbottom has recently struck more cases out in that court area, stating: ''I find that striking out this claim is the only appropriate manner in which the disapproval of the court can be shown''.

    They are clearly saying there are three, not four.  They are trying for £160 per PCN.

    Looks to me as if there are four, the first reference (101473.5755D) deals with three and the second reference (101473.7266D) deals with one.

    They are clearly saying there are three, not four.  They are trying for £160 per PCN.
    Would it be a good idea to send them this and suggest they drop it or just let them take it to court. 

    4 pcns, three in one reference and one in another reference. I had received two different letters. Although I’m sure I read somewhere they all need to be consolidated into one case, not two separate.

    In response to your email dated the 20th of September 2021, we have placed the matter on a 30 day hold to enable you to seek debt advice.

     

    In relation to the duplicated PCNs, we have now removed the two duplicates meaning that there are now 4 remaining Parking Charge Notices.

     

    There is an outstanding balance remaining of £480.00 which remains unpaid. After your 30 day hold has ended - on the 22nd of October 2021 - the matter may progress to a claim being issued against yourself, where further fees will be incurred.

    here was their previous email to me. Clearly stating £480 for 4 pcns. They have now said the fourth is £160 so how can the other three add up to £320…

    seems like they have got another thing wrong since duplicating two of them. They now have their figures wrong too.

    Would it be a good idea to send them this and suggest they drop it or just let them take it to court. 
    No, pointless.  Honestly no point starting a silly conversation about the fact they have duplicated false added 'costs'.  They are not going to agree and it just frustrates people here, to see that suggested as if it's a silver bullet.

    Ah, I see now they have split one off. Don't say anything yet about consolidating them into one claim.

    Wait and see what the claim says and hopefully they will leave one off and that one is then stuffed by 'cause of action estoppel' (see umpteen zillion posts about that).

    Hi all. Just an update. Previously I received two letters as discussed in the thread previously. They have now sent another letter with two pcns on now instead of just one. 

    I don’t really get where to go with this, so far they’ve changed the amount owed a few times, they’ve duplicated two of them. Now they’ve added another out of nowhere from a year later (2017)

    this time it’s ‘letter of claim’ 

    I’ll include the previous two letters here as well which the amounts owed requested don’t even add up per pcn, this is also happened in email correspondence. Do I just ignore this recent letter? Or should I try and speak to them on the phone etc to see what is going on.
