Just read the section in the NEWBIES thread about how to respond to an LBC. No link.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Robot22 said:Hi All,
I have now had the final demand to pay which I am ignoring. Can I confirm the next action will be that I await a county court hearing date? Do I need t do anything beforehand? So far as mentioned I have appealed the Charge Notice (NTK) via IAS and received the accepted rejection.
Thanks
The next stage is a court claim pack from the CCBC in Northampton , MCOL ( a long way from any court hearing date , which could be next summer !!4 -
Thanks all for info, really useful. This is all very new to me but is slowly making more sense. 1) as to how this fits in with my specific situation and the PPC involved and 2) how the legal process works.
I have now received the LBC issued by 'Litigation and Debt Dept, VCS Ltd Sheffield' . I have requested a SAR from their DPO and will also write separately to the litigation department to advise that I am seeking debt advice etc. as described in the Newbies thread.
Thanks again.1 -
Did you complain to the landowner (a foreign investment company), the landowner's agent, (Bristol Airport Ltd), and your MP?
Did you determine whether the car was stopped within the area where VCS are contracted to operate, or was it in an area that is without?I married my cousin. I had to...I don't have a sister. All my screwdrivers are cordless."You're Safety Is My Primary Concern Dear" - Laks3 -
I did to Bristol airport and my MP, but we were in the red zone. Just no way of seeing the signs or red lines early in the morning when it was dark until we had stopped..1

One question please before I write to the legal department of VCS Ltd... Specifically regarding seeking debt advice. I understand that advising them that I am seeking debt advice will slow things down somewhat and give me more time and I am happy to do this. However, do I actually have to seek this advice or can I say I am seeking it and not do so? I am more thinking of whether to waste the time and effort of these important organisations, such as the CAB, if I do not really need to....??0

The ideal reason is to gain time for a SAR reply
If you don't need the Extra time , don't bother. If you do , then email the 30 days hold notice

No you don't have to go seeking anything separate; you're getting advice from the forum about debt - the fact there is no debt - that's debt advice! Only a Judge can determine if a 'debt' exists!
Don't overthink it.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Hi all,
I have now received my Claim Form from the CCBC and have completed the AoS. I have had confirmation that this has been successfully submitted.
I am now completing my defence using the template which is really useful, thanks. I want to check that I don't send photos of the site in question (which is my main defence) with the defence statement. I read that I wait until later and send them with witness statement etc. Is it beneficial to send the photos with the defence statement as well as when I complete the witness statement or just not relevant at this stage? It would seem helpful for the court to have them with the defence statement?1
