    Most Popla appeals focus on the following

    POFA 2012
    Driver not identified
    No transfer of liability from driver to keeper
    No Landowner authority
    Poor and inadequate signage
    The CRA 2015
    The BPA CoP version 8 dated January 2020

    Etc

    Use the Popla decisions sticky thread near the top of the forum in announcements to find suitable examples you can plagiarise for your own Popla appeal , work backwards from the newest addition , !poking at the winning examples from other members

  • So....Parkingeye rejected Appeal, I've since submitted POPLA Appeal and today Parkingeye 'evidence ' was made available. I'm now not sure what to do!?
    I parked in a carpark managed by them, I didn't pay straight away (maybe 10+ mins after entering) but I paid into the parking machine paying by credit card entering my car registration. I paid for 3 hours and left after 2hrs 33mins (total time in carpark according tp Parkingeye). Parkingeye say I didn't pay at all.....I received a PCN over a month after the parking date but now in the POPLA appeal they show 2 previous letters to my work who own the car....sent within 14 days of parking. These 2 letters do not mention POFA 2012.
    In my POPLA appeal I didn't mention paying for parking in detail as I progressed the 'Golden Ticket' route by not identifying the driver, i'e. not POFA compliant, etc.
    I'm now unsure what to do.....I have contacted my credit card company who say I paid a company called International Parking Systems, 20 mins after entering the car park.....how can I prove a link to Parkingeye...I don't know but can only guess they pass on payments in someway.
    My options are to just give in and pay the £60 'good will' reduced payment or carry on with the POPLA Appeal. I have a witness to say I paid as they were there in another car meeting us.....so I can get a witness statement, plus the letter from my credit card company to say who I paid but it won't say I paid Parkingeye.
    Parkingeye submitted a 38 page word document full of their 'evidence' mainly consisting of photos........I'd attach if I could.

    What do people suggest please? .I can't get past the fact I've done nothing wrong!

    Do comments to POPLA (see NEWBIES thread about POPLA comments stage as it is covered).

    Point out that the evidence is news to you but it shows that they sent non POFA notices to your employer who appear to have named you as lessee/hirer of that vehicle. You knew nothing of that background, hence the way your appeal was worded but you DID focus on non compliance with the POFA, given that a PCN arrived (with no enclosures) very late.

    The fact it arrived with no enclosures means they have failed to meet the requirements of Schedule 4. Para 13 and 14 set out what had to accompany a Notice to Hirer and these were not enclosed at all and ParkingEye have failed to evidence to the contrary.  Therefore there is no keeper/hirer/lessee liability in this case and the notice(s) were not properly given.

    Then add anything else. Bullet points about the signage and/or landowner authority are the isusl thing but you only have 2000 characters (not words!).
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • Got confirmation in writing from credit card company reference parking payment I made through carpark machine....doesn't mention parkingeye but does refer to a parking fee company. Am I able to add more attachments to my popla response or do I just type these details in the comments please?

    POPLA don't let you add any new evidence at POPLA 'final comments' stage.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    I'd found this out but really don't know how to link them to ParkingEye even though their website shows a picture of a parking machine being used....can only assume machine payments flow through them?? Does anyone have any experience of this please??
  • I'm fast running out of time with regard to adding comments to my POPLA appeal after seeing the Parkingeye 'evidence'........my main issue is that I paid to park and did not exceed the time I paid for. Parkingeye say that I didn't pay at all......I can show I paid someone £4.50 for 3 hours parking but its not Parkingeye directly. The evidence pack sent by Parkingeye in response to my POPLA appeal shows details I wasn't aware of, the fact they claim they sent 2 PCN's to my employer (both non-POFA) before sending one to me (non-POFA) well over a month after the alleged offence. No evidence was offered at PCN stage nor whilst Parkingeye rejected my appeal. I've read through a number of the 'Newbie' threads reference POPLA comments and looking at the Parkingeye evidence ref signage I think I'd have difficulty pushing this as there looks to be a lot of small (800x600mm) signs which show £100 in large font whilst there is plenty of tiny font.......ultimately I paid and I cannot get past this. I've drafted my POPLA comments several times now and would like constructive feedback........ if anyone has chance to review it would be greatly appreciated:-

My original Appeal to ParkingEye  stated that car parking was paid for at the machine via contactless Credit Card. Tesco Bank confirm that £4.50 (for up to 3 hrs) was made to ‘Parking Fee’ postcode KT15 2LE Ref No. 85481471212326682818195. I believe this to be ‘International Parking Systems (UK) Limited must be linked to ParkingEye. ParkingEye state no payment was entered for XXXXXX but this was not the case. Mr X.XXXXXXX of XXXXXXXXXX, NN11 XXX witnessed this ticket purchase, he also received a PCN after paying the correct payment to park immediately afterwards. I have a witness statement available however this was not submitted......if I'd seen the 'evidence' ParkingEye have now submitted I definitely would have done so in my POPLA submission.
