    No POFA warning , timescales , if you don't know why , you haven't studied the newbies FAQ sticky thread properly or compared your NTK to a POFA compliant NTK PCN. The law is clear , don't comply and the law is a barrier and only the driver may have liability , comply and a keeper may well have liability

    This  is all explained with a photo example of a ParkingEye golden ticket, in post #3 of the NEWBIES thread.  Go look!

    Ask your friends if theirs is also a golden ticket!   Yours is.

    Add an extra line to the template appeal, stating that you can see the NTK is non POFA in wording and payment was made so they will lose at POPLA so they may as well cancel the PCN.

    Your friends must do the same BUT TELL THEM NOT TO SELECT ‘DRIVER’ in the drop down menu, of course!

    This is completely explained in the NEWBIES thread.

    Last thing - please please do not come back asking us what to do if you get a reply from ParkingEye, begging to be told who was driving.  Spare us! It’s obvious what to do with that.

  • Thank you both. I've been reading through the newbie sections now I'm home from work. As pointed out I believe I have a golden ticket so I'll use the template and extra lines as suggested making sure I don't say I'm the driver and go from there

    When filling out the online appeal it asks why I'm appealing.....as expected every reason starts with the word 'I'....should I select that 'I paid for parking' or 'I was not the driver of the vehicle'? Thanks....I don't want to implicate myself unnecessarily

  • So today I received an email back from Parkingeye reference me appealing the PCN......I did not state that I was the driver, said I was the keeper. Email was to 'Sir/Madam' rather than me by name and simply pointed me to a pdf attachment referenced to my appeal........letter is below. I did buy a ticket entering my reg in the machine at the carpark but don't have the ticket.......the ticket was for longer than parkingeye say that I stayed.
    Would be great to get advice on my next steps please???? (i've deleted reference numbers):

    Dear Sir / Madam,
    Thank you for your appeal in relation to the Parking Charge incurred on 30 July 2021 at
    14:37, at Berrycoombe Car Park, Cornwall car park.
    The evidence you have provided shows that the payment for parking was made at an
    invalid location, or via a payment service that is not associated to Parkingeye. As such,
    our records confirm that no parking was purchased to allow your vehicle to remain within
    the site for the duration of the stay.
    We are writing to advise you that your recent appeal has been unsuccessful and that you
    have now reached the end of our internal appeals procedure.
    If you wish to have your case independently assessed, please be advised, there is an
    independent appeals service (POPLA) which is available to motorists who have had an
    appeal rejected by a British Parking Association Approved Operator. Contact information
    and further information can be found enclosed. See also www.popla.co.uk
    By law we are also required to inform you that Ombudsman Services (www.ombudsmanservices.
    org/) provides an alternative dispute resolution service that would be competent
    to deal with your appeal. However, we have not chosen to participate in their alternative
    dispute resolution service. As such should you wish to appeal then you must do so to
    POPLA, as explained above.
    Please note, if the Parking Charge was issued in Scotland/Northern Ireland, only the
    driver can appeal to POPLA (Parking on Private Land Appeals).
    As a gesture of goodwill, we have extended the discount period for a further 14 days from
    the date of this correspondence. If you appeal to POPLA and your appeal is unsuccessful
    you will not be able to pay the discounted amount in settlement of the Parking Charge,
    and the full value of the charge will be outstanding. If you have already paid the reduced
    amount, the Parking Charge will be increased to the full amount and the remaining
    balance will be due.
    A payment can be made by telephoning 0330 555 4444, by visiting
    www.parkingeye.co.uk/payments or alternatively by posting a cheque/postal order to
    Parkingeye Ltd, PO Box 117, Blyth, NE24 9EJ. Please ensure you write your reference
    number on the reverse of any cheque/postal order so the payment can be allocated.

    Thank you, is there guidance on how to appeal to Popla? I have a 'golden ticket' but no evidence to buying a parking ticket other than a dated credit card receipt on my statement for the correct  3 hr value however it states 'parking fee london'......credit card company are useless and cannot help identify who I paid.

    Sorted thank you, have pulled a template from the newbies post....essentially focuses on issuing parking notice after 14 days and not being able to identify driver
