Aos completed 23rd augustWith a Claim Issue Date of 16th August, and having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Monday 20th September 2021 to file your Defence.
That's a little over a week away. Plenty of time to produce a Defence, but please don't leave it to the last minute. To create a Defence, and then file a Defence by email, look at the second post in the NEWBIES thread.Don't miss the deadline for filing a Defence.4 -
Thank you for confirming the dates for me I worked it out to be sooner, the 18th.
I will write the defence, do I post it on here for comments ? Is it best to post it to Northampton or use the online site, worried posting will eat into my time frame.0 -
The 18th September is a Saturday.Dollydespair said:Thank you for confirming the dates for me I worked it out to be sooner, the 18th.

A deadline for filing a Defence, or anything else, is never going to be a Saturday Sunday or a Bank Holiday.4 -
You neither post nor use the online page on MCOL. This is all explained in the template defence thread.

You need to slow down and read every reply very carefully and follow the instructions exactly
If you don't , I guarantee that you will make costly mistakes and probably lose because of your inattention2 -
Hi, I have now received a response from my SAR with photos of the car but no evidence to show that i left the site. i am about to use your template to write my defence and wanted to know is it wise to leave all your numbered points in it if i dont fully understand them ? Is it necessary to change the font to Times roman 12 ? How vague am i supposed to be at this stage, and why does the court expect someone with no legal experience to be able to write a defence in this manner. Is it detrimental to my claim if I just use my own words?

Yes it’s detrimental if you use your own words. However, I want you to use your own facts in point #3. That’s why it’s left open to you to edit (but NOT remove paragraphs!).We win 99% of defended claims here on this forum, but out in the wider world when we hear about cases where people write it themselves, PPCs usually walk all over the victim.
I am sure you do understand the template defence when you read it methodically. I’m not legally trained and it’s not written in legalese.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thanks so I only add my own words in 2 and 3 and the rest of the points are left unchanged which appear to all be about the excess charging0

Correct , plus no landowner authority and poor signage is also covered
No changes to any paragraph except for 2 & 3
You are not expected to defend yourself , you are expected to employ a solicitor at great expense , same as the claimant parking company usually does , so its either pay hundreds of pounds for a legal eagle , or the dIY route , hence why you are doing the latter
If you watch Rinder on TV , the defendants represent themselves !! So are you
Post your draft 2 & 3 below for critique3
