Letter Before Claim - Gladstone Solicitors UK Car Park Management Limited

19th of this month, the solicitor has sent me a PDF with there defence outlying my defence is void as the arguments can be found online and no admittance of who was driving the car. 

We were residents in the development at the time and have tried to make this point.

I havent received anything from the court themselves yet just the email from solicitors saying they wont be attending. 

Just a bit worried now that may lose and am better off paying before court

No point in paying anything now. The cost won't increase unless you are found to have behaved unreasonably.

You know the case has been transferred to your local court.

With great urgency you need to ask your local court what is going on.
Do they have your correct address?
Are they sending stuff for you to the correct address?
Ask them to resend everything they have allegedly already sent you.

If the Claimant has already sent you their Witness Statement and evidence then you can be assured that your Witness Statement is due for filing - if not today, in the very near future.

Have you prepared your Witness Statement and evidence?
It is eleven months since you last posted on this thread. Nothing wrong with that - it's great if you have managed without help - but I fear things are a little bit out of control at this moment.

Standard bullying tactics. Do not let them put you off, but please DO take note of what @KeithP said at 6.15 and act upon it quickly

Thanks both have sent urgent email to the courts to find out more info, i did send a defence months ago will i be able to add on to that. As a resident in the block of flats and leaseholder i hope this helps.

Also, if i go to court and lose do i get a CCJ instantly if lose?

You might want to phone the court and explicitly ask those questions.
Courts are known for taking their time in answering emails.

No. IF you were to lose, you would be given a period within which to pay. I believe around 28 days. As long as you do pay within the stipulated time, no CCJ will appear on your record

You cannot amend your defence without paying a fee.

I have tried to call the court several times but it says not accepting calls and the line goes dead. Is it worth going to court or does it cost a lot more in fees if I lose or is there a way to mediate a lesser fee

If they (Gladstones) have sent you their client's WS and evidence, and mentioned the date of the hearing (this month?) then crack on with your own WS and evidence and get it emailed to the court tomorrow.

Recent good WS can be copied and adapted in about an hour of so.  See threads by @aphex007 or @Daiapolon2021 and find their FINAL completed WS bundles.

And ask in the body of the email for a copy of the hearing Order, as you have never received it but have seen something from Gladstones mentioning the date (but no time nor directions/deadlines).

Have emailed the court and tried to call repeatedly the phone lines are off. 

Having no luck and it’s on Friday
