Autosec DCB Legal - PCN from 2017 (Resident Parking)

    I received a letter towards end of Dec from HM Courts & Tribunals Services dated 21st of Dec 2021, acknowledging my defence.

    Today I received an email from from DCBLegal stating their client intends to proceed with the claim, with their N180 form attached.

    I then checked Money Claim Online, and the last status update was "Defence received on 21/12/2021".

    While I wait for DQ from CCBC,  I had a look at the N180 form online and have 2 questions:

    D1 Hearing Venue - Do I need to specify a location? Or can I include "Defendant's home court" (DCBL'sN180 stated "Claimant's home court" ) 
    D4 Hearing (Dates not available - myself) - I am due to give birth in less than 3 months, do I put the month I am due? Or it's very unlikely that I will get a hearing date within such short period of time?

    D1 - I would put the name of your local County Court. You can find that by using www.gov.uk/find-court-tribunal. Although most hearings these days are by telephone anyway.

    D4 - I would suggest you state that you are unavailable for a month either side of the due date.

    D4 very unlikely to be before the birth , but I would put the month you are due , plus maybe the month after , just in case

    It's probably helping the court because they may have no slots for months !!

    This is very typical of the roboclaims model ... they're bullies who often back down when the victim stands up to them. This really is an abuse of the court system.

    Just like to add a bit to this

    DCBL have backed out at the last minute on nearly all the court cases involving Autosec - that’s 7 in the last couple of months that I am aware of - 5 in the Hull area, 1 in York, and now this one - if anyone is still at court or LBC stage involving these 2 - don’t back down!!!

    There are a lot of problems with contracts and consent - and Baysentry solutions who “bought” the business have inherited a can of worms - probably from a lack of due diligence but what would you expect from a PPC.

    What a waste of your time and energy this was, and why should there be such an enhanced money/litigation regime in private parking?

    It's truly horrible being pursued for £100 for no reason, by an ex-clamper aggressive firm, isn't it? We know how horrific and draining this is, even for robust people who see right through the scam.

    There will be one window of opportunity later this year for you to be heard by Govt, who are changing the law in 2023.  I am involved in setting that new law as I was on the Steering Group that created the proposed statutory Code of Practice.

    But we need your voice too.

    Together, we can stop the rotten parking industry from riding roughshod over the new statutory Code and the charge level caps, and otherwise bullying all motorists forever, using the regulation to gain kudos and status.

    Full story above but basically, the PPC money-grabbers have blocked the new Code with Judicial Reviews.

    Stopped the declared and much welcomed parking code from February 2022, which stated that added £70 false 'DRA fee' extortion was to be banned and that parking levels would start at £50.

    This year (Autumn, hopefully) will be your chance to make a difference, plus any other drivers you know (family, friends) who are also fed up to the back teeth with the greedy and unscrupulous parking industry and the stranglehold they have on people.

    We need VERY high numbers of real victims to make a point of responding to this final Consultation.
