Your own engineer has failed it. I don't see how contacting Baxi will help, since it's not Baxi that will pass your boiler. Either an opinion from a different engineer or your local authority that issues Building Regulations is what you need.

Good luck. If struggling I'd phone Gas Safe Register 0800 408 5500 and explain the situation even the bit about differences of opinion on here. Hi tillycat, are other house's in the development the same style and have any of them had changes made to the flue.You mention the name of house style/builder, would it be worth looking up to see if that style of house is still being built and if newer builds have any difference's.Play with the expectation of winning not the fear of failure. Unfortunately the industry is filled with engineers with absolutely no common sense,
In an idea world
should the flue be further away from the downpipe = yes
should the flue be further away from the eves = yes
would I be slightly concerned about the two vents in the soffit = maybe
would I issue a CP12 = every day of the week
op unless you are going to rent you don't need a CP12 (safety cert),
phone another engineer & get them to do the certI'm only here while I wait for Corrie to start.

to bend the rules when the liability is so significant. Is that really worth the fee for the gas cert?0
