Comments

  • The Government Internal Audit Agency (GIAA) carries out audits of PPCs for the DVLA. This FOI request shows the ratings given, from Red (worst), to Green (best), for the past 6 years.

Definition of Red, Amber and Green ratings -

The DVLA has a lot to answer for.  Keller Lenkner, the lawyers asking motorists to place a claim against the DVLA will be armed with this information.

    As
    Keller Lenkner say ..

If you have received a private parking fine between 2019 and 2021, the DVLA could have breached your data and you could be due thousands of pounds in compensation.?

This is another "no win no fee" firm and YES, there is no harm in completing their form.
However, at no time should you to pay anything up front.

This is the link for anyone wishing to register for the group litigation: DVLA data protection breach - Keller Lenkner UK Data Breach (kellerlenkner-databreach.co.uk)

There is no upfront cost, and motorists will keep 75% of any sum awarded.

Only those whose PCN was issued from October 2018 onwards should register, and only those where the keeper data was obtained by the PPC from the DVLA.

I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.

Indeed, and one assumes there is a space for other comments like yours

" Certain senior officers at the DVLA receive substantial annual bonuses based on the volume of data sold, and they will fight like ferrets in a sack to defend that."

Adding more bite to the claim

Is there any significance in this date?

That was when the Data Protection Act 2018, incorporating the GDPR, took effect.

Interestingly, the UK is the only country in Europe, and possibly the world, whose Government sells citizens' personal data to private companies.
I would be exceptionally surprised if that were true, assuming we count structures like the DVLA as "government"... to parking companies may be true. Were that the case any insurance company would be unable to trace the owner of an uninsured vehicle thats hit their policyholder's car etc.

Is this a true fact ? If so, this would make headline news especially as the DVLA insist they don't make a profit
Is there proof on this ?

You would imagine that commercial managers are set KPIs that include revenue generation and bonuses are linked to hitting KPIs... obviously parking companies are just one small part, insurers buy large amounts of information to deal with claims etc. Those with the KPIs probably are wider than just selling registered keeper details too.

I've just helped my relative to make a complaint to the ICO about the DVLA releasing his personal data without checking that the PPC had landowner authority at the specific location.

I'll have a chat with him about this "no win no fee" company and see what he says. As long as there is no risk to him I think he will go for it.

I found this on another forum,

"There is precedent in this area. The full uk electoral role used to be sold to anyone with cash. MDNA credit cards etc.
A bloke stood up and said I am compelled to give this information to keep my vote but my information is sold to spamming marketers.
In November 2001 an elector in Pontefract won a court case. It required the local ERO to stop disclosing information about him on the electoral register to commercial concerns which intended to process this for direct marketing purposes.
In this situation the distinction is a bit more subtle. Owners/keepers are responsible for the use of there cars 24/7.
You can’t dodge a speeding ticket by saying I don’t know who was driving the car registered to me.
However criminal and civil contract enforcement are worlds apart."
