Dcbl letter regarding PCNs

Options
Hey all,

Really sorry to create a new thread.

I have read through reams and reams of posts regarding these letters.

I have received 9 letters from DCBL regarding PCNS in a private car park . These letters are the first that I have received regarding this matter.

The 14 days are up on the 17th of Aug. As advised by the threads I havent contacted DCBL.

As I didnt receive the PCNs I can no longer appeal. The tickets were allegedly issued in 2018 however , for each of the alleged offences i assumed that i was on a car park list. However, i have since found out that an incorrect number plate was supplied to the private parking firm. They have acknowledged to the Employer that this is the case. However, that i should have responded to the previous PCNS but i did not receive them. They also stipulate that on one of the alleged offences i was parked in a hatched area i checked the details of the pcn number from the debt collectors letter on New Generation parkings website and this isnt the case. Also they have advised that there are 19 offences however, i have only received 9 letters from dcbl.

So in a nutshell:
1) does the date of contravention on the letter from DCBL have to match the date of the photographic evidence of the PCN
2) Can i apply for a SARS access request at this stage would this prove that the original pcns were never issued and all the data they hold on me. Also the other pcns?
3) as i parked there thinking that i was on the list surely no breach has occurred as when my number
Plate was issued it was one digit out
4 ) I am not sure of the next course of action can anyone help please?

DCB Limited or DCB Legal? The former can safely be ignored but not the latter.
If the latter, then read the guide to court written by bargepole that you will find in the second post of the NEWBIES.

    Who is the PPC?

What happened when you complained to the landowner?

Send an SAR asap. Include proof of ID such as a copy of your V5C or redacted utility bills/bank/card statements. Do not include photo ID.

Check that the address on your V5C is correct. Have you moved since the dates of the alleged events? If so, send a correction notice to the DPO of the PPC instructing them to erase your old data and replace it with your current address for service.
    Again, include proof of ID.

I have received 9 letters from DCBL

Surely that is worth a counter claim for harassment if this goes to court.  Have yu complained to your MP?

So it's dcb ltd and New Generation Parking Management , NGPM ?

    1) the only paperwork that matters are the PCN s from NGPM , not dcb

    2) the SAR email to the DPO at NGPM is about you , the data subject , nothing to do with parking or PCN s , they should reply with all documents , pictures and data relating to you

    3) there may have been a breach , but frustration of contract because the management gave the incorrect VRM registration to NGPM , beyond your control. But you should have dealt with his at the time , or when PCN s arrived , o. Judge may not be happy with it getting to court , if it does. NGPM have 6 years to issue a court claim pack from the CCBC in Northampton

    4) email a SAR to the DPO at NGPM

    Hey,

I know longer have the vehicle but when I did have it I didn’t receive any notices of any PCNS . But, I moved address so there is no guarantee that they didn’t go there. I registered the car to my new address about a year before I sold it and still no letters.

Do you mean write to the DPO at NGPM? What info do I need to include? I.e how do I word it? Will attaching a utility bill suffice? Or do you recommend a bank statement too?

With regards to the SARS request will that show all the info they hold on me including if they even issued the previous PCNs?

The date of the contravention on the PCN letter is different from the date that the photo was taken in the car park is this normal? As on one day it says I had 2 contraventions but the pics in the car park are for two separate days.

Is it worth pursuing this as I was parked there but thought I was covered by being on the car park list. However, the number plate that was supplied to the parking management company was incorrect. The correct number plate was then added after all the offences that I didnt receive any notification of

Use the SAR template for wording , add copies of 2 recent redacted utility bills as proof of I D under the GDPR law , a recent redacted bank statement is ok too

It was your legal responsibility to update the DVLA quickly when you moved house , so your problem if no letters arrived , not theirs

No longer owning the vehicle is completely irrelevant , nothing to see there

Get your copies of the PCN s first , straight from that DPO , then check them forensically

Get written proof of the error by whoever was responsible , written evidence is crucial , all of it , on paper , for a judge to see

All a parking company has to do legally is obtain the registered keeper details from the DVLA and post them out !  Job done. The fact that the wrong address was used is your fault , which they will mention in court

    Hey,

Okay thanks I see what you mean.

Do I still need to change my address and contact the DPO at NGPM as well as doing the SAR (which I know are 2 separate requests) but both to the DPO at NGPM

    Okay thanks.

I am really confused why the date of contraventions on the letter from DCBL doesn’t match the photographic evidence in the car park? So I can’t pay it anyway as I wasn’t in the car park on those  dates. So I can’t pay it just based on that alone to start with

Get your SAR response, lay everything out, do the cross checking then determine exactly what is what. We may need to see what it is you have.

Ultimately you might need to put all your evidence in front of a Judge. So get all your ducks lined up now.
