    I have now received the following request regarding my email to challenge the original SARS request:

    Individuals have the right to receive a copy of their own personal data when they initiate a Subject Access Request.

    Personal data only includes information relating to natural persons who: can be identified or who are identifiable, directly from the information in question; or who can be indirectly identified from that information in combination with other information.

    All of this information is available to you in the document provided 24/08/21.

    We do not store personal information against permits and therefore any permits stored on our system are not included under a Subject Access Request as vehicles often change hands over time and we cannot conclude if a permit is directly linked to specific driver. In addition to this, a vehicle permit is not classed as personal data as we only store the vehicle registration, its start and its end date.

    We are satisfied we have have actioned your request correctly and that you have a copy of all personal information we have on file in a readable format.

    If you require copies of documents that use this personal information then you must direct your request to our debt collection partner DCBL who are dealing with these cases.

    I am going to escalate this now to the ICO can anyone recommend any further advice at all please?

    Despite what they say, a vehicle's registration mark is personal data.

    Anyone with reasonable cause can use that VRM to ask the DVLA for the name and address of the vehicle's Registered Keeper.

    Letter Before Claim support: 

    I have read the newbies thread which was super helpful thank you. 

    Just got a quick question I have already:
    - completed the SARS request and the parking company didn’t handle this correctly
    - I escalated this to the ICO who found that the parking company did not comply with their data protection obligations. As a result they wrote to them giving them 7 calendar days to respond which they didn’t.

    I have followed the newbies thread and am emailing their Solicitors the following info:
    (a) I am seeking debt advice but I deny any debt and the case must be put 'on hold' for not less than 30 days under the PAP for debt claims 2017.
    (b) I have sent your client a SAR to which they did not respond appropriately in accordance with their Data Protection Obligations 
    (c) the ICO wrote to your client about their information rights practices and a timescale of which to respond to my original request 
    (d) your client failed to respond 
    (c) correct 'address for service' (insert address)  

    Would you put in that they haven’t handled the SAR correctly and about the ICO or present this as evidence in court? 

    Any support would be greatly appreciated

    Tell the claimant and their solicitors now, then tell the court as well that the claimant was being unreasonable by not processing your data request properly and in a reasonable manner, putting you, the defendant at a disadvantage, and that this matter has been upheld by the ICO.
