It does make you wonder how a third party can legally obtain DVLA details without written landowner’s authority, especially when their client has no such authority in the first place...
again from the DVLA website
"They must provide evidence which shows they are acting on behalf of the land owner"
The BPA therefore rightly state in the CoP "you must have the written authorisation of the landowner"

Discontinued
Had a court date in which he was instructed by the judge to bring along his landowner contract - bit difficult for him as it was a verbal contract
Could also have been my complaint to the BPA where I complained he was using TNC who had no landowner contract to access DVLA data, I can imagine his pals at TNC not being too happy with him, they probably took him at his word and now have awkward questions to answer from the BPA and DVLA
Or maybe my ongoing complaint with the ICO for his non compliance which implicated DBLC, it seems no one has any data on me and there is no data controller
Who knows the reason? Anyway another win thanks to this forum
Thanks for your help

Was the discontinuance done in a timely fashion, or was it done within an unreasonably short time before the hearing date, such as week or less?
If it was unreasonable, you should be asking the court for your costs.I married my cousin. I had to...I don't have a sister. All my screwdrivers are cordless."You're Safety Is My Primary Concern Dear" - Laks3 -
Good result, even though you missed the opportunity and satisfaction of putting your case in front of a Judge. PDG reverted to type, as the bully he is ...... he ran away.
Reiterating what @Fruitcake asked above re an unduly short period of notice of discontinuation, which might give you a possibility of twisting the knife a little more! Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

That's two he's run away from now. It's a shame we've not had chance to rip him to shreds in court. Congratulations @holderness.4

Well done - it gives me hope, spent the last couple of evenings getting my case together it’s been moved to hull County court on his request - I think the court hearing set in Liverpool was just extra pressure on me to think of the journey and time costs and give him his £300. Which I don’t intend doing as it’s not reasonable. Still this win creates hope.
well done - it’s a shame we cannot prosecute him for the hassle of his scam2 -
