I have nothing no, the only thing I have is another lady at the time left her car and stated it was free but I don't have her name, I have no photos as I never thought about it, in hindsight I would have taken photos,
Do I just wait for BW legal to send me another letter now?0

            I don’t see that you have a defence.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Never take the word of some other customer as gospel , the signs are what mattered , especially if a ticket machine was covered , preferably always take pictures at the time. I doubt that an NCP car park was free , covid19 or not , it's how they generate money
You are now awaiting an N1 court claim pack from the CCBC in Northampton , a court claim2

I thought I had read somewhere I should be sent photos of the car park and signs? I may have misread something there though, once I get n1 court pack I have to start my defence, or seems I have lack of defence do I now have to bite the bullet and just pay?0

No, because they have enhanced the PCN by £60 or £70 for no reason so you wouldn’t be wanting to pay that. You would get photos of car park and signs in their evidence bundle before a hearing. However, I am telling you that the fact your Council said all their car parks were free never affected private pay and display car parks, of course not. So that is not a defence at all.The fact (if true) that all machines were covered is a potential defence so you could email BW Legal now and state that you require, under the pre-action protocol for debt claims, images of the signs and machines in place that day and the machine logs (VRMs redacted) to show whether it was taking payments at that time. Your position is that the machines were covered and not taking payments and you want to narrow the issues now, to avoid court.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Ok I understand about the car parks situation, IMO that should have been made clearer,
I have contacted bwlegal previously asking for details so I will await what they send me next and see what I can do from there, the last thing I want to be doing is attending court1

Keep the pressure on BW Legal, rather than waiting, they will not be patiently working through a list of people who have asked for info, it is in their interests to do nothing and wait for you to pay or to issue a N1 claim form via CCBC. These days one does not "attend" court, it is a video or telephone hearing in the comfort of your own home/office.SOTP34POD said:Ok I understand about the car parks situation, IMO that should have been made clearer,

No-one here wants to attend court and no-one does these days as it’s done by phone. But you will get a court claim unless you narrow the issues now and if their replies show that payment methods were working, consider making an offer of say, £60 (the reduced PCN sum) which they won’t accept but they will counter offer.
But that comes ONLY after narrowing the issues and getting them to show that evidence.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I have drafted this email to send over to bwlegal
Good afternoon,Thank you for placing the account on hold, I am requesting under the pre-action protocol for debts and claims, the following information: images of the signs and machines in place that dayThe machine logs (VRMs redacted) to show whether it was taking payments at that time.I would appreciate if these could be sent to me ASAPKind regards0

I didn’t say ‘debts and claims’ - that’s not the name of the protocol. I also made it very clear that you need to state why you are asking, what your position is (use my words, they were written for you).PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
