Ok I initially was getting letters from Trace debt recovery and now BW legal both on behalf of the client0

I have spoken to Sir Greg who has asked me to thank you for your email. He is sorry to hear of the problem you have experienced.
Although his Parking (Code of Practice) Act 2019 is now law, the Code of Practice mandated by that Act has not yet been put in place and therefore the provisions of the Act are not yet in force.
Sir Greg is pleased to see that you have contacted your own MP - which is the correct way of proceeding due to parliamentary protocol.
Sir Greg hopes incidents of the sort you have described will become less of a problem when the Code of Practice under his Act is in force.
Kind regards

I replied after this but no response so left it tbh. I mean I have gone to my mp I go to greg knight and nothing. Just keeping eye on the letters and any court action and will fight it there.

Hi there I wanted to check if this is a letter of claim? If so would the next stage be to request a SAR to bw legal and National car parks? Also I never got a rejection of my appreal os would SAR help to see this information.
What if your LBC-stage complaint to the landowner doesn't get the PCN cancelled?

It is headed Letter if Claim, so yes. Also I never got a rejection of my appreal os would SAR help to see this information.yes.What if your LBC-stage complaint to the landowner doesn't get the PCN cancelled? You win when defending a court claim. No risk, no big deal, no CCJ etc as long as you follow our advice. Read some claim threads to gain confidence.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi just on the above. Where it says 'issuing a claim against you in the county court without further notice' what does this mean. I will be made asware of the ccj right?
Is there anyway for me to take them to court0 -
It means that they are now free to issue a County Court Claim against you.Sam87 said:Hi just on the above. Where it says 'issuing a claim against you in the county court without further notice' what does this mean.
From that it follows that you will need to defend yourself against any such claim.
Yes, but you do understand that a County Court Claim is not the same as a County Court Judgment, don't you?Sam87 said:I will be made aware of the ccj right?
Back in March @Coupon-mad told you...
What have you done since March?Coupon-mad said:No risk, no big deal, no CCJ etc as long as you follow our advice. Read some claim threads to gain confidence.
Have you read any court claim threads?
Why would you want to do that?Sam87 said:Is there anyway for me to take them to court3 -
Oh ok thats fine as long as I am aware of any proceedings. I just asked for all data they had which they sent but the parking company has not sent yet and been over 30 days so will chase up. I will read the claims thread.
The only reason is I will not pay this and fight it but if they are gonna do anything would like to hurry up and in fact even make a claim against them all this for an overstay of 15 mins when i wasnt even parked in the zone. I am also trying to get a morgagage so dont need anything messing this up0 -
The fact is that if BWLegal want to risk court over this they may well lose and face paying your costsSam87 said:I am also trying to get a morgagage so dont need anything messing this up
If you lost (doubtful as BWL are adding fake amounts that government has banned), as long as you follow the instructions of the court and that is a date to pay, you do that and the matter is over. NO CCJ and no risk to your credit score
If you did not pay as instructed, it would be you who will mess up your credit score
You are 100% safe2 -
A court claim, when defended, doesn't affect a mortgage and isn't a CCJ.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
