DCB Legal for CP Plus re Road Chef / Moto PCNs – Advice on defence against Claim

Hi
Well just had my court hearing.
It quickly came apparent that the claimant / DP Legal had not submitted their Witness Statement and asked for an adjournment, and relief from sanctions.I counter claimed saying they as a professional organisation had the same amount of time as myself to prepare and present their witness statement and should know exactly how to adhere to court requirements regarding filing, and asked for my costs and additional costs for unreasonable behaviour to be awarded.
After spending hours on this, and having a clear defence that would show the disgraceful behaviour of CP Plus and DCB Legal, I was really anticipating showing the claimant for what they are before the court.
The Judge went through a three stage test to see if the claim should be struck out for violations of clear court directions, and stated that after the review the claim would be struck out.
The Judge then awarded costs for Standard Witness Costs at the maximum of £95, and additional costs of 10 hours at £19 totally £190, which was lower than the amount claimed of £342. Indeed i spent more like 50 hours plus on this not just 10.
So in total i was awarded costs of £285, payable within 14 days.
Thanks for all the help and input.

Nice one, very well done. ✔️Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
