    Flipping heck, how can there be a 4 page thread in one day, about a bog standard CP Plus PCN that isn't a POFA one and is won at appeal simply by not saying who was driving?

    Re PCN number
    I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I will be making a complaint about your predatory conduct to your client landowner.

    I was not the driver of the vehicle, and there will be no admissions as to who was driving and no assumptions can be drawn. Since your PCN is a vague template, I require an explanation of the allegation and your evidence. You must include a close up actual photograph of the sign you contend was at the location on the material date as well as your images of the vehicle.

    If the allegation concerns a PDT machine, the data supplied in response to this appeal must include the record of payments made - showing partial VRNs - and an explanation of the reason for the PCN, because your Notice does not explain it.

    If the allegation involves an alleged overstay of minutes, your evidence must include the actual grace period agreed by the landowner.

    In additional the NTK came outside of the POFA deadline arriving on the 14/05/2021 therefore there can be no keeper liability.

    I wasn't the driver at the time, but the person who was has proof they were shopping at the wharf (receipt from River Island) but no proof of parking. There was multiple parking machines out of order and the one that they did use they paid cash and as this happened in April no proof was kept.

    I'm asking if the charge can be ended as they were paying customers to one of your sites stores, and the penalty amount is excessive and not a true loss of earnings as the car park is always pretty empty and charges like this just add to people not visiting the wharf stores.

    No I never received a reply from either the agent or owners. I did however receive a reply from my appeal today and the case has been dropped.

    No I never received a reply from either the agent or owners. I did however receive a reply from my appeal today and the case has been dropped. 
    Yay, well done. Almost inevitably the PoFA angle will have dissuaded them from going further with this when they can't hold the registered keeper liable and they've no idea who the driver was.

  • Hi! I myself have just received a fine from the same company at the same site on the Crown Wharf. I distinctly remember paying and using my contactless payment. I took the ticket and was parked for 50 minutes. Unfortunately it seems the money didn’t leave my account, so I don’t know what happened :(

    Is there anything I can do?
