OK I will have to convince her to go to court then. TBH she is not to happy about it because it is really my mistake.
But as I said from the start being charged these extortionate amounts from a simple mistake cannot be justified.0 -
The time for declaring you as driver has passed. Chances are it won't be an actual physical hearing (unless you've been told that already) but a telephone/video/TEAMs or Zoom hearing.1

Hang on ... WHO is the named defendant? You or your wife?
If it's her then she HAS to attend the hearing - she has no choice unless she wants to lose AND possibly be liable for unreasonable behaviour costs! (You can't simply attend on her behalf - you can be her Lay Rep but she still needs to attend).
If the claim is against you then they already know who the driver is.

No the claim is against my partner as the owner of the vehicle. There is no indication that I was driving. I have done everything myself but in my Partners name so there should not be an issue there.0

I have just realised we should have sent the WS to Bwlegal before the 21st of April. Unfortunately I missed this, would this have any implications?

Just do it now, this weekend...when is your hearing? WS and evidence has to go to BW and the local court. Can be by email.

Yes I emailed it to the Courts on the correct date, but missed sending it to Bwlegal (emailed it earlier). Hearing date is the 17th of May, typically the family managed to catch Covid at my Mums funeral and we are only just getting back on our feet.
