I am still working my way through the posts which are incredibly helpful. Before I do any of the steps I am thinking about the defence. If my memory is right it wasn't a paid car park and was free for 2 hours. I do not think there is anyway i could have been there longer than 1 hour tops due to my working hours at the time - Can I post my defence here for you to tell me if I am on the right track or is that too outing?1 -
Definitely post your 2 adaptations of your Defence below , adapting paragraphs 2 and 3 from the coupon mad Defence template from the sticky thread announcements at the top of this forum ( but not the rest of it) , in fact you would be foolish not to
A few recent threads on here have had Moto cancel the court claim and PCN , so do the email complaint asap , by reading what they did
But you need to do everything we tell you to do , no assuming , no leaving things out , so all of our advice is relevant
Nothing beats a Moto cancellation2 -

i got a letter of claim in January this year for a supposed parking ticket from July 2015. I ignored the letter thinking it will become statue barred soon. Today I have received a claim form for Northampton County court.
what should I do? If I offer to pay instalments will I still be given a CCJ?Is there anyway to fight it due to the timeframe? I don’t ever recall the parking ticket or any letters but I have moved house a few times since 2015.I have read a few threads here but not sure of the answers
DCBL ARE SCAMMING YOU WITH FAKE AMOUNTS ?

ok this forum is brilliant thank you
I could be barking up the wrong tree with this defence but it doesn't add up that I would park there for too long2. It is admitted that the Defendant was the registered keeper of the vehicle in question but liability is denied.
The Defendant does not recall the day the said parking fine was issued due to it being almost 6 years previous, but accepts it is likely she was the driver of the vehicle due to the location of the parking notice being in proximity to her workplace at that time. The defendant also does not recall receiving any parking fine, or any letters relating to it.
3.
The location of the parking offence being discussed was a free for 2 hours car park. At that time the defendant worked nearby and used the services on a daily basis at lunch time and on the way to work. The defendant was contracted to working hours of 8am-5pm with 30 minutes for lunch. The defendant used the services at lunch time between the hours of 12pm-2pm and for no more than 30 minutes so the defendant does not agree to the allegation that “the vehicle remained on private property in breach of the terms and conditions” as quite simply there was no need for the services to be used for longer than 2 hours due to the defendants scheduled working hours. The defendant used a breakfast and after school club between the hours of 7:50am and 6pm which meant there was no free time to spend at services prior to or after work taking into account the defendants home address was some 40 minutes away from the location in question.

In 2 do not admit being the driver , if it's not known on an unremarkable day 6 years ago , say so
It is for the claimant to prove their case , do not assist them1 -
Ok Thank you I have found the email address for MOTO Ceo but can’t seem to see any wording I can use to complain
any tips on what to say? I am going to hopefully send the email tomorrow0 -
I think your paragraph 3 says it all, and give PCN ref , Court claim ref , VRM of the vehicle involved in 2015 , your name and address and name of the Parking Company , C P PLUS , asking him or her to intervene ASAP and get it cancelled with a quick discontinuance to follow , in writing

Obviously say how you feel about being sued for your family using MOTO services correctly in 2015. Say how it tarnishes the name of MOTO, etc and what you would like them to do about it, given you are not being sued. GET ANGRY ABOUT IT - THIS ISN'T ON, IS IT?
. I did tell you that I wrote a stroppy version only this past week so it's easy to find if you want to send a more polite version of that.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Write to CEO ken.mcmeikan@moto-way.co.uk and Commercial Manager paul.comer@moto-way.co.uk.
Moto can get these cancelled at any stage, even if already a court claim.
Yes, you do get 2 hours free parking at MOTO sites so it sounds like you have probably been 'double dipped' i.e that they recorded you coming in on the first visit and leaving on a second visit whilst conveniently ignoring the exit of the first visit and entry of the second.
Write a strongly worded complaint to both emails as per advice above. I would include stuff like - appalling way to treat regular customers (which you are), caused you a lot of worry & consternation, unfeeling way to behave in the middle of a pandemic, you will think twice about revisiting if that's the way they treat customers etc but the most important point is that MSA's are supposed to be havens of refuge for the weary motorist so they have to take notice of the safety aspect 'Tiredness kills-take a break' or 'Don't drive tired'. Lay it on thick!!
