Have you sent an SAR yet? That is the best way to request all data, including all four images of the vehicle. A complaint will be made to the ICO if these are not provided.

Complain to the BPA, the DVLA, and their KADOE team about the data breach.

Bailiffs are not involved. Do you mean solicitors or debt collectors?
Yes, I have had requested SAR and received the data (2 photos of the car and 2 photos of just a number plates on white background, copies of PCN and remainder) I posted the copy of an email earlier.

Debt recovery firms: DCBLTD and Debt Recovery Plus Limited. The DRPL I have not contacted yet because haven't received anything from them but they might hold the wrong data.
    Who's the KADOE exactly?

    Thanks

Are you able to show, on the balance of probabilities, the your vehicle was actually somewhere else overnight?
I'm afraid I can not. I must check my old iphone accout if I can dig something out, but I wasn't using or sharing location on it.
    Thanks

Abbreviations common to the parking forum can be found in the fifth post of the NEWBIES.

KADOE, Keeper At Date Of Event, the agreement between the scammers and DVLA that enables them to obtain keeper data.
Obtaining personal data without justification is a breach of the DPA/GDPR and a breach of the KADOE contract.

If you requested all photos, or all four photos of the vehicle, remind the scammers of this and give them a week to respond else you will complain to the ICO.
Follow through with the complaint if the do not provide the images.

Certainly that is one example that should convince a judge.

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

It doesn't matter. You would have asked for all of your personal data which includes your VRM, and they have failed to provide it because you know there are (or should be) two additional photos.
I would still point this out to the scammers and give them a week to respond before complaining to the ICO.

Shall I help them in an email and give the time frame (approximately 5-10 minutes after/before checking IN/OUT of the gym) to search for the missing images when my vehicle was leaving previous and entering the next day?

Why limit them to a particular timeframe?
We have seen posters who discover they have other PCNs from a different date to the ones they are dealing with.

It's up to you, but they already have the first entry/last exit times and dates. You have asked them for ALL your personal data. You could say that since the car left and returned within those two times, you know that there are at least two more images that they have failed to provide. Alternatively, they have been deleted either deliberately or due to an error, and you want confirmation of this.

Absence of their existence is not proof they do/did not exist.

it may well be that these photographs no longer exist, even if they existed in the first place. Data protection regulations forbid the holding of personal for longer than is necessary. I would expect them to erase their entry and exit records and the associated photographs pretty quickly unless they were evidence for a parking charge notice. It would certainly be a breach of data protection to hold onto every entrance and exit record for five years.
the issue is, of course, that they should have found the evidence of your intermediate entrance and/or exit and not issued the ticket at all. One day when I'm bored I I'm going to do the statistics of this.
