You are right; I think that was added at a time when CCBC were failing to send defences to claimants or at least claimants were claiming they had not received them. The CCBC will send a copy of your defence to the claimant. @Coupon-mad, is it still good advice to copy in the solicitor and will you be updating that advice when you edit the template thread - I know you are waiting until after the judicial review before doing so.spencer999 said:in the template it says email the defence to the court and to the solicitor?? Sorry for sounding daft all through this thread, my grown up daughter died of cancer over Christmas and I'm finding it v difficult to absorb information. no matter how straightforwardly it's presented!4 -
I think it doesn't matter either way. You can copy in BW to the defence if you want. Or don't! As long as the D gets an acknowledgement from the CCBC, all is good.
I was more worried that the OP might be emailing BW to tell them about the SAR (an unnecessary email at court defence stage). People make that mistake a lot.
I am so sorry to hear about your beautiful daughter, @spencer999 - cancer is horrific as I know from my own family (sadly most people will experience it). There are no words, except to keep her memory alive and talk about her often. Sending you peaceful, calm vibes.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thanks folks
Just got acknowledgement from the courts
"if the dispute cannot be resolved informally, the claimant will inform the court that he wishes to proceed. The court will then inform you of what will happen"
I guess that at that stage it will be time to give a more detailed defence, and also to specify which court the defendant wants the case to be heard in? Unless judges are still working from home??1 -
You cannot give any sort of defence (more detailed or otherwise) except for the one that you have already submitted. Well you can but it costs over £100. You might be referring to a witness statement that backs up and supports your defence with evidence. Have you not been reading the NEWBIE sticky to see the process? You should receive a DQ - N180 form once the claimant has informed CCBC that they intend to proceed and in that you select your court and give any dates that you will not be available.2

yes but I have found the surfeit of info very confusing, that's a fault on my part, I know it's all there. OK when the N180 is received then we can submit dates, court, and witness statement. Bingo0

.... except witness statement will not need to be sent until you receive a court allocation and date.1

nothing received yet apart from another letter from BS Legal (my name for them) that basically says, our client is DEFINITELY going ahead, and our client is DEFINITELY going to win, so this is your VERY VERY LAST CHANCE (apart from all the other last chances) to pay up before we come and GET YA3

Having trawled back through this thread, it was mentioned early on that this was a ticket for parking on an NCP car park on railway land. If so, why has there not been any mention of no keeper liability for the last 2 years? Was the driver's identity blabbed at any point?
One other point and please correct me if I'm wrong, but from what I can gather, the OP is writing and doing all the legwork here but the claim is actually against his wife who is the RK, in which case at some point she is going to have to sign or use her name on the documentation and I'm hoping that the Defence was signed in her name and that the DQ and WS will also be in her name?2
