That's sorted it.  PoFA paras 13 & 14 nicely read, understood and put into your own words for the appeal opening.

I don't know what your POPLA deadline is, but if there's time, see if there are any other inputs from regulars.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

  • Will do. I'll hold off for a day or two to see if anyone else has something to add. Really appreciate the assistance.

You get 33 days from the day you get the code.
You get one shot at this. One

So dont rush it. For example if you talk about signage, have you put embeddded photos in, to show the signs are bad?

You must not rely solely on links to external sites (e.g. for POFA) as tyou have no g'tee they can or will follow those links. EVERYTHING that proves your side is embedded in that single PDF you will produce.

PremierPark failed to send a copy of the required documentation, either with the original Parking Charge Notice or the subsequent reminder.

To make it absolutely certain that PoPLA get the no hirer liability point, I think I would add to that sentence.
    Perhaps something like...
PremierPark failed to send a copy of the required documentation, either with the original Parking Charge Notice or the subsequent reminder and therefore they have failed to transfer any driver's liability to the keeper.

OK so would you suggest I go and take photos myself?

You do everything possible to bolster your case , because you get one chance at this , you cannot add new evidence after the popla appeal has been submitted

Looks fine to me, that is a good 'Hirer' version of a POPLA appeal.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

OK so I have a bit of an issue now. They have submitted their response to my appeal which consists of 2 pdf files. One is 61 pages of signage and the other one is named after the case number but when I click on it it says "failed to load PDF document." and the size of the file is 0kb. I have tried on two different devices and get the same result. Any idea what to do?
