Yes, that seems a reasonable thing to suggest they could have done, to avoid the parking charge in the first place.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

An update and advise please. I sent my Defence on 9th June. Yet to receive the my directions questionnaire. I phone the court today and they advised ES parking/Gladstones have not instructed them to proceed. I have received a Directions questionnaire from Gladstones/ES parking to mediate which I have ignored. Court said they only generate once they instruct them to proceed
Is this normal? Do Gladstones take this long?
Have received second court form. Have acknowledged. Will be sending defence soon. Probably just send same (amend with ref no)1

Is this normal? Do Gladstones take this long? The CCBC sent you a letter saying the Claimant had twenty eight days to consider your Defence. What you don't know is when the CCBC sent a copy of your Defence to the Claimant. It follows from that that it is not known when the Claimant has to respond to the CCBC.Further, we don't know what delays there are in the CCBC that means they don't send you a DQ as promptly as you might like. Can I suggest that you keep checking your MCOL Claim History and as soon as you see that the CCBC has sent a DQ to you, you are ready to download a DQ, complete it and fire it back to the CCBC, remembering to send a copy to the Claimant of course.4

Yeah I received a letter from the court dated 9th June saying they acknowledge receipt of claim and a copy is being served on the claimant. Could ring and ask when it was actually served.
I received a letter from Gladstones dated 21st June with their Directions Questionnaire . Presume it was served between 9th and 21st June.
It stated they have notified the court of the claimants intention to proceed (Are they lying then).0

Download a copy of the DQ from court forms freely available online and fill it in, and send it to the CCB and Gladstones, saying in the body of your email that Gladstones have written on 21st June saying that they ''have notified the court of the claimant's intention to proceed' so you are attaching your DQ because Gladstones have filed theirs and you don't want to miss any deadline.
Also mention the claim number of the new claim that has just arrived and ask that both claims are put before a Judge to consolidate the 2 claims because they involve the same parties, car park and duplicate facts and should not be allocated out as separate claims or it costs the local court wasted time and money and clearly the Claimant should have advanced their entire case as ONE claim, not split across two duplicate claims (save for dates of PCNs). Issuing a spate of claims is an abuse and you ask that both claims are referred to a Judge at the CCBC to consolidate and require further and better particulars before the cases are allocated.Have received second court form. Have acknowledged. Will be sending defence soon. Probably just send same (amend with ref no)Nope, not quite the same. If it's from the same parking firm claimant, about the same car, same car park, similar facts but just another crop of PCNs, you need to also add near the start, the usual wording you will find from other defences, when you search the forum for Henderson v Henderson consolidate and look through the results for a defence based upon similar 'two claims' facts.PRIVATE 'PCN'? Have received my Notice of hearing. Will be over the phone on 23rd November with a 2 hour slot.
There is nothing mentioning when I have to submit a Witness Statement by? Do I still send and when by? Is this normal?0

Is there nothing that mentions '14 days before the hearing', often appears on the reverse of the letter? Check it carefully, line by line.manutd99 said:Have received my Notice of hearing. Will be over the phone on 23rd November with a 2 hour slot.

I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

If you've had a previous order then it may even be on that ... just that at that time the date of the hearing wasn't known. Jenni x2 Jenni x2

Not sure if witness statement itself can be have pictures in the document. Can you also send via email which I might try to do as cannot go to court office
