Parking Ticket - Gladstone Solicitors
Hope can someone can help. Have read newbies thread. I have also once previously won in court over a parking ticket with the help of people on this board about 3 years. ago. Hopefully not much changed since and its good to see familiar names on the board especially coupon-mad. Love your dedication.
Due to issues I've not been opening some of my post. After opening I have realised I have received 2 parking tickets (no windscreen). I have also received 2 LBC's from Gladstone solicitors.
Company in question is ES parking Enforcement. Done research and as I have received a LBC it seems more than likely I have to go to court. As I have been through the process its not much of a concern. Although the case seems abit simple.
At my workplace they have permit system. Seems on those 2 days my permit must have fallen down. No windscreen ticket was left. Although it seems as I work there and it should be easily overturned. Hopefully the case but several others where I work have not had theirs overturned despite appealing and saying they work there so appeal process without surprise doesn't work. Have looked into the landowner and its not someone who you can really contact. His name is Charles Dunstone.
As per newbies thread I need to send a SAR. I have read on another thread that the Notice to Keeper for ES parking is not POFA complaint. Is it worth emailing Gladstones and ES parking about this? If so can some give me some pointers why it isn't POFA complaint? Managers and reception have no influence on the parking company so cannot help. Anything I can do influence ES parking company to overturn as others have failed (Numerous people). As its simple I work there and I have a permit. Hopefully an easy win in court if it gets there although wouldn't mind as there is security guard who works there once told me no one has won yet.
How do you explain to ES parking?. Obviously wouldn't admit to be the driver. So is it a case of the Keeper of the car works there and has a permit?

If this were to end up in court they might struggle, read this an complain to your MP.

If the driver and keeperr are the same, then coming clean now makes your defence that much simpler to wriet, and more convincing to read3

Have you been in touch with the owner(s) and CEO of the company you work for?
Are you a member of a trade union? If so, your rep should be all over this.
Who brought in the scammers. your employer or the landowner? That is to whom complaints should be made.
Complaints should also be made about the poor quality of the permits. They sound like they are not fit for purpose and have been deliberately made such that they fall down instead of sticking to the windscreen.
I had numerous parking permits issued to me when I was employed, and they never ever became unstuck even after years of use.
Get pics of the site and signage.

Work for very large company so complaining so complaining to the CEO/owner of the company is virtually impossible. Quick google search. They have 61,000 employees. Owner of the land (as per first post) is the owner of the contract I work on. Still a large company so would not really care about one person's or even parking tickets of our office. We don't have a trade union. Not sure why they even have a permit system. Not in city centre so no reason for anyone other than workers to park there. They give tickets on petty reasons. Most people unfortunately end of paying. Number of colleagues have received for being outside the parking bay which is small (bay).
I don't like sticking things on my windscreen. Guess my fault for not having on those days..

You are way past the appeal stage. Get stuck into the guide to court written by bargepole that you will find in the second post of the NEWBIES. This is a step by step guide from LBC to the court hearing. Then have a look at the template defence in the sticky threads. You will only need to change paragraphs 2 and 3 when you get to that stage.

Personally I would complain to the landowner/company CEO irrespective of how many employees there are. If everyone who gets a scamvoice did this, something might actually get done about it. You can't appeal. Landowner cancellation will work.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Guess cant appeal. I still have my Defence saved from 3 years ago. Il have to reword to suit this one. Landowner is too high up to email (Charles Dunstone).

As you enter the car park there is no sign. You turn left as soon as you enter. Cars parked on left hand side and right hand side. The signs are on the left hand side. It is positioned in a very stupid place. Once the row is full of cars the sign it is so low that the signs are not visible (hidden behind the boot of car). Several rows of cars on right hand side and no signs. All I need to do is take pics when left hand side is full so basically cannot see the signs. One sign at the end of car park but hardly visible. Cant believe the position of these and that they haven't placed any signs on the right hand side. One row of cars on left and several rows on right. Signs on a big fence.
2 major points for defence. I have a permit already and signs not visible. Hopefully sufficient to win.

I have now received one claim form
Date of Issue 7th May. I submitted Acknowledgement of service 22nd May. What date do I have submit my Defence by?
I will using my defence from few years ago and amending for this claim
Can I still request a SAR? Yeah should have done after LBC but too many things going on at moment so didn't.
I have taken pictures of car park. As above when the park is almost full which it is usually by the time I start work most of the signs are covered by cars and there only a few signs visible so have taken pics when full.
The pics given to me are very small so needs better pics. As a I had 2 separate tickets I have only received claim form for one ticket. You'd think they would combine. Seems 2 different days in court if other comes which I presume it will.
Has anyone lost after getting help from this board? As obviously a small part of me thinking hope I don't lose but as I have a permit and signs are not visible hopefully I have a strong case.

Defence deadline is 33 days after the issue date , but not weekends !! So 7th plus 33
Check the Oct 2020 Defence template by coupon mad , plus crib from any old ones too
A SAR to the DPO at the PPC can be done at anytime , nothing to do with parking , but GDPR
If it's 2 claims for the same place and PPC , you will be asking for the 2 claims to be consolidated if a second claim arrives
There is the odd loss here , but many are discontinued or members win , so usually good chance of winning
No evidence is submitted with the Defence3
