So I am in the period now where my POPLA appeal was unsuccessful and I am getting the obligatory debt collector emails, text messages and letters from Gladstone’s requesting payment etc.

I am aware that the next action for me is to wait until the LBC and then react accordingly.

However, my question is would it be plausible to make contact with Gladstone’s and ask then to either stop contacting me or take the necessary action to take this to court?

I really can’t be doing with their correspondence for the next 2 years!!

Seen all the recent threads on the government consultation and DVLA.  It really is a sad sad world when these scamming pieces of vermin are profiting on underhand schemes in an economic climate that has many people struggling to put food on their tables.

You can block their phone numbers but you cannot stop the mail.  You do not want to block mail anyway as you might miss a N1 claim form!  That way leads to default CCJ - just what you DON'T want.

Received a Letter before Claim today from Gladstone’s on behalf of OPS dated 14 Sep 21 (no date stamp on the envelope but strange it took 7 days to arrive but hay ho!)

SAR sent to OPS as per newbies thread.

Quick question on the email to Gladstone’s ref 30 day extension for debt advice. Am I right in saying I can send this at any time within the 30 days so I could leave it until as late as 13 Oct? Or is it best to just send it now.

I was actually happy to receive it (although only a letter before and not a claim) I would much rather they took me to court early instead of having it hanging over me for 5 years.

I wouldn't leave it to the last day but yes you could do it a few days before the deadline

    Ok thanks
  • So after receiving the LBC from Gladstone’s (for OPS) I sent my SAR request and got all the information back. I also sent the email to Gladstone’s to seek debt advice for the 30 days extension etc etc.

what happens now?  Am I just waiting for an actual county court claim? Or will they respond again?

They may respond again , who knows ?

Yes you are awaiting a court claim pack from the CCBC in Northampton , probably after the 30 days hold has expired !

Use the time to plan your Defence , gather pictures etc , check the SAR reply data for errors , omissions and flaws etc

And don't disregard plan A , plan A is your best option , it ALWAYS is !

Thanks, are they likely to send it quite quickly after the 30 days or could they wait for any period in the 5 years (or whatever the timescale is!)

I have tried plan A a couple of times. Never get a reply unfortunately

Yes, either of those are a possibility.

If I were a parking company, I would do it sooner rather than later. Next year, and those beyond, are likely to be very lean times for them.

6 years in England and Wales , so anytime until Feb 2027 , so they are likely to keep you on the hook , with more threatening letters , but could start a court case from Jan 2022 until February 2027 , it's their call
