Who is the notice addressed to? i.e. who does it say needs to pay? (You may simply be copied on the standard notice inviting the Claimant to pay the hearing fee if they wish to continue with the claim after receiving your defence).

I understand from the defence template I submitted as the wording indicates:

In the matter of costs, the Defendant seeks:

    17.        (a) standard witness costs for attendance at Court, pursuant to CPR 27.14, and

    (b) that any hearing is not vacated but continues as a costs hearing, in the event of a late Notice of Discontinuance.  The Defendant seeks a finding of unreasonable behaviour in the pre-and post-action phases by this Claimant, and will seek further costs pursuant to CPR 46.5.

    18.  The Defendant invites the court to find that this exaggerated claim is entirely without merit and to dismiss the claim.

They obviously take this to result in me wanting to submit a counter claim?

I don't mean the name and address on the notice - of course it has your details as you've received it through the post! I mean (and even said) what does the wording on the notice say? Who is the wording addressed to - Claimant or Defendant? How about you show us exactly what the notice you've received says, rather than what the template defence says? ;)

Redact your details , reference number etc , no personal information at all , use card or similar if it's a letter , take a picture , post it as an attachment to your reply , but double check it because we do not want any of your details showing

Both you and the claimant get the notice , but the claimant has to pay a fee , you need to remember that paperwork is copied to all parties involved

@Le_Kirk well that's what I'm confused about I copied the defence template provided on here, all paragraphs the same except for my adjusted 2 paragraphs.  The template has the following in which I'm wondering if they have taken to mean I am counter claiming?  But I cant see anyone else having this happen from the same template?

In the matter of costs, the Defendant seeks:

    17.        (a) standard witness costs for attendance at Court, pursuant to CPR 27.14, and

    (b) that any hearing is not vacated but continues as a costs hearing, in the event of a late Notice of Discontinuance.  The Defendant seeks a finding of unreasonable behaviour in the pre-and post-action phases by this Claimant, and will seek further costs pursuant to CPR 46.5.

    18.  The Defendant invites the court to find that this exaggerated claim is entirely without merit and to dismiss the claim.
